REGULATIONS UNDER THE DEFENCE ACT 1903-1973, THE NAVAL

DEFENCE ACT 1910-1973 AND THE AIR FORCE ACT 1923-1973.*

I, THE GOVERNOR-GENERAL of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Defence Act 1903-1973, the Naval Defence Act 1910-1973 and the Air Force Act 1923-1973.

Amendments of the Defence Force (Salaries) Regulations†

Service Allowance.

1. Regulation 10 of the Defence Force (Salaries) Regulations is amended by omitting from sub-regulation (1) the figures “ $750.00 ” and substituting the figures “ $950.00 ”.

Uniform maintenance allowance.

2. Regulation 14 of the Defence Force (Salaries) Regulations is amended by omitting paragraph (e) of sub-regulation (3) and substituting the following paragraph:—

“ (e) an Apprentice in the Naval Forces; or ”.

Senior Chaplain’s Allowance.

3. Regulation 16 of the Defence Force (Salaries) Regulations is amended by omitting the figures “ $268.00 ” and substituting the figures “ $278.00 ”.

Rations and quarters charge.

4. Regulation 19 of the Defence Force (Salaries) Regulations is amended by adding at the end thereof the following sub-regulation:—

“ (8) For the purposes of this regulation, a medical officer performing a year of compulsory residency in a hospital shall be treated as if—

(a) he were a category 0 member; and

(b) the residential quarters provided to him by the hospital were service accommodation.”.

Schedule 10.

6. Schedule 10 to the Defence Force (Salaries) Regulations is amended—

(a) by omitting the words:—

“ Sub-regulation 15 (1)

Sub-regulation 15 (2)

Sub-regulation 15 (3) ”,

and substituting the words:—

Regulation 15

Sub-regulation 15a (2) ”; and

(b) by inserting after the words:—

“ Sub-regulation 95 (5) ”,

the words:—

“ Sub-regulation 113 (4)

Sub-regulation 113 (5) ”.

Schedule 11.

7. Schedule 11 to the Defence Force (Salaries) Regulations is amended—

(a) by omitting from the second column of the item relating to regulation 7a the words:—

“ (c) being a medical officer or dental officer, within the meaning of the Defence Force (Salaries) Regulations, holds the rank of a Commander or a higher rank; or

(d) he is an officer referred to in sub-regulation 15 (6).”,

and substituting the words:—

“ or (c) being a medical officer or dental officer, within the meaning of the Defence Force (Salaries) Regulations, holds the rank of a Commander or a higher rank.”;

(b) by omitting the item relating to sub-regulation 15 (6); and

(c) by inserting after the item relating to sub-regulation 117b (4) the following item:—

“ Sub-regulation 129 (2)

Insert in paragraph (a) after the word ‘uniform’ the word ‘maintenance’.”.

Application.

8. (1) The amendment of regulation 10 of the Defence Force (Salaries) Regulations effected by regulation 1 of these Regulations applies to and in relation to—

(a) members of the Naval Forces and of the Military Forces—as if that amendment had come into operation on 1 November 1974; and

(b) members of the Air Force—as if that amendment had come into operation on 31 October 1974.

(2) The amendments of regulation 16 of the Defence Force (Salaries) Regulations and of Schedules 2, 3, 4, 5 and 6 to those Regulations effected by regulations 3 and 5 of these Regulations apply to and in relation to—

(a) members of the Naval Forces and of the Military Forces—as if those amendments had come into operation on 12 July 1974; and

(b) members of the Air Force—as if those amendments had come into operation on 11 July 1974.

(3) The amendments of Schedules 7, 8 and 9 to the Defence Force (Salaries) Regulations effected by regulation 5 of these Regulations apply to and in relation to—

(a) members of the Naval Forces and of the Military Forces—as if those amendments had come into operation on 20 September 1974; and

(b) members of the Air Force—as if those amendments had come into operation on 19 September 1974.
