2. Statutory Rules 1973 No. 100 as amended to date. For previous amendments see Note 2 to Statutory Rules 1980 No. 1 and see also Statutory Rules 1980 Nos. 1, 4, 9, 20, 23, 34, 42, 43, 55, 73, 132, 142, 148, 155, 174, 216 and 217.

Overview

The Interim Determination under the Defence Amendment Act 1979 was made by the Minister of State for Administrative Services on behalf of the Minister of State for Defence on 5 August 1980. This legislative instrument amends the Defence Force (Salaries) Regulations to update the rates of salary and allowances for various ranks within the Navy, Army, and Air Force, as well as for chaplains and other members. The policy objective is to ensure that the remuneration for Defence Force members is kept up to date with prevailing economic conditions and to reflect the cost of living adjustments. The amendments apply to members of the Navy and Army from 18 July 1980 and to members of the Air Force from 17 July 1980.

Scope and Application

This legislation, the Interim Determination under the Defence Amendment Act 1979, is an administrative instrument that amends the Defence Force (Salaries) Regulations, specifically concerning the salary adjustments for various ranks within the Australian Defence Force (ADF). It applies to members of the Navy, Army, and Air Force, and these amendments to the salary regulations apply to service performed on or after 17 July 1980 for the Air Force and 18 July 1980 for the Navy and Army. The amendments involve increasing the salary allowances for service personnel, including service allowance, special allowance for senior medical and dental officers, and senior chaplains' allowance. Additionally, it repeals and replaces the existing salary schedules with new ones that specify the rates of salary for officers based on their rank and years of service. This legislation is a Commonwealth instrument and is part of the broader Defence Amendment Act 1979, aimed at ensuring that remuneration within the ADF is periodically reviewed and adjusted to reflect changes in economic and service conditions.

Key Provisions

The main operative sections of this legislation, the Interim Determination under the Defence Amendment Act 1979, revise various allowances and salaries within the Defence Force (Salaries) Regulations. Regulation 10 now specifies a service allowance of $1438, replacing the previous amount of $1380. The special allowance for senior medical and dental officers is increased from $3752 to $3910, and the allowance for $1821 is raised to $1898. The senior chaplains' allowance is adjusted from $616 to $642. Furthermore, the legislation repeals and replaces Schedules 1, 2, 4, 5, 6, 7, and 9, introducing new salary structures based on rank and years of service. The Act imposes specific obligations on the Defence Force personnel, particularly regarding the revised allowances and salary structures. These adjustments are to be applied to service provided by members of the Navy and the Army on or after 18 July 1980, and to members of the Air Force on or after 17 July 1980. These changes ensure that all personnel are compensated in accordance with the updated regulations. Breaches of this legislation may result in various civil or criminal consequences, although the specific penalties are not detailed within the text. Typically, non-compliance with defence regulations could lead to disciplinary actions, financial penalties, or other administrative measures as prescribed by relevant laws and Defence policies. The precise penalties would depend on the nature and severity of the breach, and would be determined in accordance with applicable military and civilian laws.
