Application

3. The Defence Force (Salaries) Regulations as amended by regulations l and 2 apply to and in relation to service by—

(a) members of the Navy or of the Army—on or after 23 December 1977; and

(b) members of the Air Force—on or after 22 December 1977.

Overview

Statutory Rules 1978 No. 4, made under the Defence Act 1903, the Naval Defence Act 1910, and the Air Force Act 1923, address the need for updated salary regulations for members of the Australian Defence Force. Enacted by the Governor-General, acting on the advice of the Federal Executive Council, these regulations provide a structured approach to updating the remuneration of defence personnel. The policy objective is to ensure that the salaries of defence force members are equitable, reflective of their rank, experience, and the duties they perform, thereby maintaining the motivation and efficiency of the defence force.

Scope and Application

The Defence Force (Salaries) Regulations, 1978, applies to members of the Royal Australian Navy, the Australian Army, and the Royal Australian Air Force. These regulations are made under the Defence Act 1903, the Naval Defence Act 1910, and the Air Force Act 1923. The regulations apply to service by members of the Navy or the Army from 23 December 1978 and by members of the Air Force from 22 December 1978. The regulations include schedules that outline the annual salary rates for various ranks and categories of officers and members within each of the defence forces, including provisions for male and female officers, chaplains, and medical and dental officers, among others. The regulations also detail salary rates for members undergoing training and those in specific training capacities. These regulations supersede and replace previous Defence Force (Salaries) Regulations, with amendments and new schedules provided in the 1978 regulations.

Key Provisions

The Defence Force (Salaries) Regulations, as amended by Statutory Rules 1978 No. 4, introduce significant updates to the salary structures for various ranks and roles within the Australian Defence Force, effective from specified dates. Regulation 16 updates the Senior Chaplain's allowance from $346 to $351. Schedules 1 to 9 have been repealed and replaced with new schedules detailing the annual rates of salary for different categories of officers and enlisted members. These schedules cover a range of ranks and roles, from Rear Admirals to Seaman, and from Major Generals to Privates, across the Navy, Army, and Air Force. These regulations impose specific obligations on the Australian Defence Force to ensure that all members receive salaries in accordance with the new schedules. For example, officers who hold ranks such as Rear Admiral, Major General, and Air Vice-Marshal must be compensated according to the updated rates specified in Schedule 1. Similarly, enlisted members, such as Seaman and Private, must be paid in line with the rates detailed in Schedules 7 and 8. These obligations ensure that all members of the Defence Force receive fair and updated remuneration based on their rank and experience. Failure to comply with these regulations could lead to legal consequences. While the specific penalties for non-compliance are not detailed in the text, breaches of employment regulations generally can result in civil penalties, including fines and legal action. Additionally, non-compliance could lead to disciplinary actions within the Defence Force, impacting the careers of those responsible for ensuring adherence to these regulations. The precise penalties would depend on the nature and severity of the breach, as well as the internal policies of the Defence Force.
