3. The amendments of the Defence Force (Salaries) Regulations effected by these Regulations apply to and in relation to—

(a) members of the Naval Forces and of the Military Forces—ass if those amendments had come into operation on 19 September 1975; and

(b) members of the Air Force—as if those amendments had come into operation on 18 September 1975.

Overview

The Statutory Rules of 1975 No. 197, made under the Defence Act 1903-1975, the Naval Defence Act 1910-1975, and the Air Force Act 1923-1975, aim to update the Defence Force (Salaries) Regulations. Enacted by the Governor-General of Australia, acting with the advice of the Executive Council, these regulations address the need to adjust salaries and allowances for members of the Australian Defence Force, ensuring they remain competitive and reflective of service-related increments and inflation. The regulations also aim to standardise pay scales across the Navy, Army, and Air Force, thereby ensuring equitable treatment of personnel within the defence forces.

Scope and Application

The Statutory Rules 1975 No. 197, made under the Defence Act 1903-1975, the Naval Defence Act 1910-1975 and the Air Force Act 1923-1975, amend the Defence Force (Salaries) Regulations by adjusting the Senior Chaplain's Allowance and replacing existing salary schedules for various ranks and roles within the Australian Defence Force. This regulation applies to all members of the Naval, Military, and Air Forces, with different effective dates depending on the specific force. The amendments concern the remuneration of officers and enlisted members, including those in training, by setting out specific salary structures based on rank, years of service, and other qualifying factors. The regulation does not explicitly state any exclusions or exemptions, implying that the outlined salary structures apply broadly across the Defence Force. The regulation extends its application through detailed schedules that specify salary rates for various ranks and positions within each Defence branch, providing a comprehensive framework for the remuneration of Defence personnel.

Key Provisions

The Statutory Rules 1975 No. 197, made under the Defence Act 1903-1975, the Naval Defence Act 1910-1975, and the Air Force Act 1923-1975, primarily amend the Defence Force (Salaries) Regulations, which govern the salary structures for various ranks within the Australian Defence Force (ADF). Regulation 1 of the Rules changes the Senior Chaplain's allowance from $297.00 to $307.00. Regulations 2 and 3 replace the existing Schedules 1 to 9 in the Defence Force (Salaries) Regulations with new schedules that detail the annual rates of salary for officers and members across the Naval Forces, Military Forces, and Air Force, categorized by rank and years of service. The amended regulations impose obligations on the ADF to ensure that the salaries of its members are paid in accordance with the new schedules. For instance, the schedules provide specific salary rates for officers holding specified ranks (Schedule 1), male officers other than those holding specified ranks or described in other schedules (Schedule 2), and female officers and male nurses (Schedule 3), among others. These obligations extend to updating internal payroll systems and ensuring that members are compensated according to their rank and years of service as per the new regulations. Any breach of these regulations, particularly in the payment of salaries not in accordance with the new schedules, could lead to legal consequences. Although the specific offences, penalties, or consequences are not detailed in the provided text, under general legislative principles, failure to comply with salary regulations could result in civil or administrative penalties, including the requirement to rectify any underpayments, pay interest on the amounts owed, and potentially face disciplinary action. Additionally, persistent or willful non-compliance could attract more severe penalties, including fines or other sanctions as deemed appropriate by the relevant authorities.
