Overview

The Defence Force Retirement and Death Benefits (Annual Rates of Pay) Regulations 1977 is a legislative instrument enacted under the Defence Force Retirement and Death Benefits Act 1973 by the Administrator of the Government of the Commonwealth of Australia, acting with the advice of the Federal Executive Council. This regulation was introduced to amend the existing regulations concerning the annual rates of pay for Defence Force personnel, ensuring that the rates are updated in line with changes in economic conditions and service requirements. The policy objective of this regulation is to provide fair and adequate remuneration for Defence Force members, recognising their service and contributions. This regulation ensures that Defence Force members receive updated and fair compensation for their service, addressing the need for periodic adjustments to maintain the relevance and competitiveness of these rates.

Scope and Application

The Regulations under the Defence Force Retirement and Death Benefits Act 1973 apply to members of the Navy, Army, and Air Force, specifically regarding their annual rates of pay. The regulations are applicable to service performed on or after 1 April 1977 for Navy and Army members, and on or after 31 March 1977 for Air Force members. The regulations establish new annual pay rates for certain ranks and adjust the pay rates for various categories of chaplains and members undergoing training. The scope of these regulations is limited to the annual rates of pay for defence force personnel and does not extend to other areas of the Defence Force Retirement and Death Benefits Act 1973. The application of the regulations is further defined through the subordinate instrument, which includes detailed pay scales based on rank, years of service, and specific training capacities.

Key Provisions

The main operative sections of the Statutory Rules 1977 No. 82 involve amendments to the Defence Force Retirement and Death Benefits (Annual Rates of Pay) Regulations, which were initially established under the Defence Force Retirement and Death Benefits Act 1973. These Regulations detail the specific annual pay rates for various ranks within the Navy, Army, and Air Force, including amendments to specific pay scales and the replacement of certain schedules (Section 1). Schedules 3 and 4 are particularly significant as they outline the annual pay rates for chaplains and members undergoing training, respectively (Section 2). The Regulations impose clear obligations on the relevant parties to adhere to the updated pay scales for the specified ranks and categories. For example, chaplains with varying years of service now have distinct annual pay rates, and members undergoing different types of training are compensated according to the specific schedules outlined (Section 2). The Regulations also specify that these amendments apply to service from particular dates, namely 1 April 1977 for members of the Navy and Army, and 31 March 1977 for members of the Air Force (Section 3). Failure to comply with the updated pay scales as stipulated by these Regulations could potentially lead to disputes or financial discrepancies. However, the text does not explicitly mention any specific offences, penalties, or consequences for non-compliance. The primary focus appears to be on ensuring that the pay scales are accurately updated and applied to the relevant service personnel, thereby maintaining equitable compensation within the Defence Force.
