Overview

The Statutory Rules 1980 No. 10, an interim determination under the Defence Amendment Act 1979, was enacted to address discrepancies and inefficiencies in the financial compensation framework for Defence Force Reserves. This legislative instrument, dated 29 January 1980, was issued by the Minister of State for Administrative Services acting on behalf of the Minister of State for Defence. The primary policy objective was to revise and standardise the pay rates for various ranks and positions within the Defence Force Reserves, ensuring that remuneration is equitable and reflective of the responsibilities and service duration of the personnel involved. This interim determination sought to provide immediate amendments to the existing financial regulations, effective from 4 January 1980, with specific provisions applying retroactively to duties performed as of 2 July 1979.

Scope and Application

The Interim Determination under the Defence Amendment Act 1979, dated 29 January 1980, made by the Minister of State for Administrative Services on behalf of the Minister of State for Defence, amends the Defence Force (Reserves) (Financial) Regulations to adjust the pay rates of certain officers within the Australian Defence Force, effective from 4 January 1980. Notably, it specifies new rates for high-ranking officers such as the Chief of the Army Reserve and various colonels, and it repeals and substitutes existing schedules to detail pay rates for officers and members of the Navy, Army, and Air Force based on their rank and years of service. The amendment concerning the Chief of the Army Reserve applies from 2 July 1979. This legislative instrument is applicable within the Commonwealth of Australia, specifically regulating financial matters related to the reserve forces of the Australian Defence Force.

Key Provisions

The key operative sections of this legislation involve amendments to the Defence Force (Reserves) (Financial) Regulations. Specifically, Regulation 4 has been amended to update the table detailing the rates of pay for certain officers. Furthermore, Schedules 1, 3, 4, 5, and 7 of the Defence Force (Reserves) (Financial) Regulations have been repealed and substituted with new schedules that detail the pay rates for different ranks and roles within the Navy, Army, and Air Force. The obligations imposed by this legislation primarily concern the payment of salaries to members of the Defence Force Reserves. The amended regulations stipulate the specific pay rates for various ranks and positions, taking into account years of service and other relevant factors. These pay rates must be adhered to for all members serving on or after 4 January 1980, with the exception of the amendment to the Chief of the Army Reserve's pay rate, which applies from 2 July 1979. There are no explicit offences, penalties, or consequences for breach mentioned in the text of the legislation. However, non-compliance with the stipulated pay rates could potentially result in legal or administrative consequences, given the regulatory nature of the document. The text does not provide information on the maximum penalties for breaches, if any.
