Application

3. The Defence Force (Reserves) (Financial) Regulations as amended by regulations 1 and 2 apply in relation to service by—

(a) members of the Navy and of the Army—on or after 2 September 1977; and

(b) members of the Air Force—on or after 1 September 1977.

Overview

Statutory Rules 1977 No. 160, made under the Defence Act 1903, the Naval Defence Act 1910 and the Air Force Act 1923, were enacted to amend the Defence Force (Reserves) (Financial) Regulations concerning the pay of reservists. These Regulations were introduced to ensure fair and updated financial compensation for reservists, addressing any discrepancies in pay structures across different ranks and roles within the Australian Defence Force. The Regulations were enacted by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, to ensure alignment with current remuneration standards and to provide a comprehensive framework for the financial entitlements of reservists. The objective is to maintain an adequately funded and motivated reserve force, crucial for national defence preparedness.

Scope and Application

The Statutory Rules 1977 No. 160, made under the Defence Act 1903, the Naval Defence Act 1910 and the Air Force Act 1923, amends the Defence Force (Reserves) (Financial) Regulations to alter the pay rates of certain officers and other ranks within the Australian Defence Force. These Regulations apply to members of the Navy, Army, and Air Force, with the amendments taking effect on or after 2 September 1977 for Navy and Army members, and on or after 1 September 1977 for Air Force members. The Regulations provide detailed pay scales for various ranks and roles within the defence force, including male and female officers, medical officers, chaplains, and members undergoing training. The application of these Regulations is national, as they pertain to the entire Commonwealth of Australia and its Defence Force. No specific exclusions or exemptions are outlined in the text, and the scope of the Regulations is further extended through the various schedules detailing specific pay rates and conditions for different categories of service personnel.

Key Provisions

The Statutory Rules 1977 No. 160 amends the Defence Force (Reserves) (Financial) Regulations under the Defence Act 1903, the Naval Defence Act 1910 and the Air Force Act 1923. Regulation 4 of the Defence Force (Reserves) (Financial) Regulations is updated to reflect new pay rates for certain officers, including Inspector-General of Reserves, Major Generals, Brigadiers, Consultant Colonels, Colonels, Chaplains and other specified roles. These amendments provide new salary details for these positions, replacing the previous table of rates. The schedules of the Defence Force (Reserves) (Financial) Regulations are also amended to provide updated pay rates for male and female officers, as well as for medical officers, dental officers, chaplains, and other ranks within the Navy, Army and Air Force. These updated schedules detail pay rates based on years of service, rank, and other factors. The Regulations impose clear obligations on the parties they govern, specifically the members of the Navy, Army and Air Force. These parties must adhere to the updated pay rates outlined in the amended Regulations, ensuring that members are compensated appropriately for their roles and years of service. Additionally, the Regulations require that the updated pay rates be applied to service rendered on or after specified dates: 2 September 1977 for Navy and Army members, and 1 September 1977 for Air Force members. Failure to comply with these Regulations may result in civil or criminal consequences, though specific penalties are not detailed within the text of the Statutory Rules. However, breaches of similar military regulations generally carry penalties that can include fines, imprisonment, or other forms of punishment as prescribed by the relevant Acts and subordinate legislation. The exact nature and severity of the penalties would depend on the specific circumstances of the breach and the relevant legal provisions.
