Overview

The Statutory Rules 1982 No. 186, issued under the authority of the Minister for Defence, amends the Defence Force (Reserves) (Financial) Regulations to address the need for updated financial regulations for reserve officers within the Australian Defence Force. Enacted in 1982 by the relevant legislature, these amendments are a direct response to the provisions outlined in the Defence Amendment Act 1979, which empowers the Minister to make interim determinations that amend or repeal existing regulations. Specifically, this statutory rule adjustment to Regulation 4 sets a new annual pay rate of $8,325 for the Deputy Director of Reserves - Air Force, a position within the Citizen Air Force, reflecting a policy objective to ensure equitable remuneration for roles of significant responsibility within the reserves.

Scope and Application

The Statutory Rules 1982 No. 186, issued under the authority of the Minister for Defence, pertain to the amendment of the Defence Force (Reserves) (Financial) Regulations. This legislative instrument applies to officers of the Citizen Air Force, specifically targeting the Deputy Director of Reserves - Air Force to establish an annual pay rate of $8,325. The regulation operates within the Commonwealth jurisdiction, impacting federal defence reserve personnel and financial arrangements. This amendment is directly tied to regulation 4 of the Defence Force (Reserves) (Financial) Regulations, which governs annual rates of pay for officers holding particular appointments. The amendment became effective on 4 May 1982, and the interim determination is considered a Statutory Rule under Section 12 of the Defence Amendment Act 1979. This provision allows for the Minister's authority to make such amendments, ensuring that the regulations remain current and reflective of necessary financial adjustments within the Defence Reserve framework.

Key Provisions

The primary operative section of these Statutory Rules is the amendment to Regulation 4 of the Defence Force (Reserves) (Financial) Regulations (section 4). This amendment introduces a new pay rate of $8,325 per year for the Deputy Director of Reserves - Air Force, a position within the Citizen Air Force. This change is intended to address the financial remuneration for this specific role, ensuring it is consistent with other comparable positions within the Defence Force Reserves. These Statutory Rules impose specific obligations on the Defence Force Reserves and the relevant officers. They require the Defence Force Reserves to implement the new pay rate for the Deputy Director of Reserves - Air Force, effective from 4 May 1982. This includes updating payroll systems and ensuring that any payments made are in accordance with the new rate. For the Deputy Director of Reserves - Air Force, the obligation is to accept the remuneration as set out in the amended regulations, recognising the new financial terms of their employment. The Statutory Rules themselves do not explicitly detail offences, penalties, or civil/criminal consequences for breaches. However, failure to comply with the new pay rate could potentially lead to disputes regarding remuneration, which might need to be addressed through the Defence Force's internal grievance mechanisms or potentially in an industrial relations forum. The Defence Force Reserves and the Deputy Director of Reserves - Air Force are expected to adhere to the terms set out in the amended regulation to avoid any such disputes. The consequences of non-compliance could range from financial adjustments to more formal dispute resolution processes, depending on the specific circumstances and the Defence Force's internal policies.
