4. The Defence Force (Reserves) (Financial) Regulations as amended by paragraph 1 (a) and clause 3 of this Interim Determination shall be deemed to have come into operation on 7 May 1981.

NOTES

1. Notified in the Commonwealth of Australia Gazette on 25 September 1981.

2. Statutory Rules 1976 No. 16 as amended to date. For previous amendments see Note 2 to Statutory Rules 1981 No. 11 and see also Statutory Rules 1981 Nos. 11, 20, 94, 114, 121, 237 and 256.

Overview

The Statutory Rules 1981 No. 2721, titled "Defence Force (Reserves) (Financial) Regulations (Amendment) Determination", was enacted in 1981 by the Minister of State for Administrative Services on behalf of the Minister of State for Defence under section 12 of the Defence Amendment Act 1979. This legislative instrument aimed to address discrepancies in the financial remuneration of certain officers and members within the Defence Force Reserves. The regulations specifically target adjustments to the salary rates for various ranks and appointments in the Army, Navy, and Air Force, effective from specified periods in 1980 and 1981. The policy objective behind these amendments was to ensure fair and consistent compensation for military personnel in the reserves, reflecting their service periods and roles accurately.

Scope and Application

The Defence Force (Reserves) (Financial) Regulations 1981 (Amendment) Statutory Rules 1981 No. 2721, made under section 12 of the Defence Amendment Act 1979, primarily governs the remuneration of officers and members of the Reserve Forces within the Australian Defence Force. It applies to various ranks and roles, including Chief of the Army Reserve, Major General, Brigadier, Consultant Colonels, Colonel, Medical, Chaplain General, and other specific appointments and roles within the Navy, Army, and Air Force. This regulation also covers the pay rates for members undergoing training and those in particular training capacities. The amended regulations came into operation on 7 May 1981, and they supersede the existing schedules pertaining to the remuneration of Reserve Forces members, effectively establishing new pay rates for specified periods. The scope of the regulation is limited to financial remuneration within the Defence Force Reserves and does not extend to other areas such as operational duties or benefits beyond financial compensation.

Key Provisions

The primary sections of this Interim Determination under the Defence Amendment Act 1979 amend the Defence Force (Reserves) (Financial) Regulations 1976. Regulation 4 is revised to provide new salary rates for certain officers within the Defence Force, effective from 7 May 1981. It specifies rates for various ranks and appointments, including Chief of the Army Reserve, Major General, Brigadier, Consultant Colonels, Colonel, Medical, and Chaplain General roles. Regulation 5a inserts new salary rates for members of the Reserve Forces for service periods from 22 July 1980 to 14 January 1981 and from 15 January 1981 to 6 May 1981, depending on their rank and role. Schedules 1, 4, 5, and 7 are also updated to reflect these new rates, with specific amounts listed for different ranks and roles within the Navy, Army, and Air Force. The Defence Force (Reserves) (Financial) Regulations impose specific obligations on the Defence Force and its members. It mandates that certain officers and members of the Reserve Forces be paid according to the amended rates specified in Regulation 4 and the new Schedules 1, 4, 5, and 7. This ensures that all eligible members receive appropriate remuneration for their service during the specified periods. Additionally, the Interim Determination requires that these new salary rates be applied retroactively to service performed between 22 July 1980 and 6 May 1981. There are no explicit offences, penalties, or consequences for breach mentioned within the Interim Determination itself. However, any failure to comply with the specified salary rates could potentially lead to administrative or legal repercussions under the broader Defence Force regulations or relevant Australian laws. The specific penalties for non-compliance would typically be governed by the Defence Force Discipline Rules or other applicable legislation, which could include fines, disciplinary action, or other legal consequences depending on the severity and nature of the breach.
