REGULATIONS UNDER THE DEFENCE ACT 1903-1975, THE NAVAL

DEFENCE ACT 1910-1975 AND THE AIR FORCE ACT 1923-1975.*

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Executive Council, hereby make the following Regulations under the Defence Act 1903-1975, the Naval Defence Act 1910-1975 and the Air Force Act 1923-1975.

Amendments of the Defence Force (Reserves) (Financial) Regulations†

Pay of certain officers.

1. Regulation 4 of the Defence Force (Reserves) (Financial) Regulations is amended by omitting the table and substituting the following table:—

Traditional.

3. (1) Where the amount that has been paid, or is payable, to a member in respect of reserve service during the period from and including the prescribed day to and including the day immediately preceding the date of commencement of these Regulations is less than the amount that would have been payable to the member in respect of that service if the Defence Force (Reserves) (Financial) Regulations as amended by these Regulations had come into operation on the prescribed day, he shall be paid in respect of that service an amount equal to the difference between those amounts.

(2) For the purposes of sub-regulation (1), in ascertaining the amount that would have been payable to a member, being a member who has been paid or is entitled to be paid an amount under sub-regulation 17 (2) of the Defence Force (Reserves) (Financial) Regulations in respect of reserve service during the period from and including the prescribed day to and including 29 January 1976, in respect of reserve service during that period if the Defence Force (Reserves) (Financial) Regulations as amended by these Regulations had come into operation on the prescribed day any amount that would have been deducted in accordance with regulation 15 of the Defence Force (Reserves) (Financial) Regulations in respect of that reserve service shall be disregarded.

(3) For the purposes of this regulation, references in the Defence Force (Reserves) (Financial) Regulations as amended by these Regulations to the Navy and to the Army shall, in respect of reserve service rendered by a member during the period from and including 19 September 1975 to and including 8 February 1976, be read respectively as references to the Naval Forces and to the Military Forces.

(4) In this regulation—

“ member ” has the same meaning as in the Defence Force (Reserves) (Financial) Regulations;

“ prescribed day ” means—

(a) in relation to a member of the Navy or of the Army—19 September 1975; and

(b) in relation to a member of the Air Force—18 September 1975;

“ reserve service ” has the same meaning as in the Defence Force (Reserves) (Financial) Regulations.
