(a) members of the Navy and of the Army—on and after 20 August 1976; and

(b) members of the Air Force—on and after 19 August 1976.

Overview

Statutory Rules 1976 No. 198, made under the Defence Act 1903, the Naval Defence Act 1910 and the Air Force Act 1923, was enacted to amend the financial regulations pertaining to the Defence Force Reserves. The regulations address issues related to the pay and allowances of reserve officers and members of the Australian Defence Force. Enacted by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, these regulations were designed to update and standardise the financial provisions for reservists, ensuring consistency and fairness in remuneration across different ranks and services within the Defence Force. The policy objective of these amendments was to provide a clear and structured financial framework that aligns with the duties and responsibilities of reservists, thereby enhancing the operational effectiveness and morale of the reserve forces.

Scope and Application

The Regulations under the Defence Act 1903, the Naval Defence Act 1910 and the Air Force Act 1923, made in 1976, govern financial matters relating to the Defence Force Reserves. These Regulations are applicable to members of the Navy, Army, and Air Force and concern the pay of officers and members of the Reserves. Specifically, the Regulations set out the remuneration for various ranks and roles within the Defence Force, including male and female officers, medical and dental officers, chaplains, and members undergoing training. The financial provisions apply to service on and after 19 August 1976 for the Air Force and 20 August 1976 for the Navy and Army. Additionally, the Regulations provide for special payments to certain officers, such as the Inspector-General of Reserves, for performing their duties efficiently. The scope of the Regulations is limited to financial aspects of the Defence Force Reserves and does not extend to other areas of military conduct or administration.

Key Provisions

The Statutory Rules 1976 No. 198, made under the Defence Act 1903, the Naval Defence Act 1910, and the Air Force Act 1923, amend and substitute the Defence Force (Reserves) (Financial) Regulations. These amendments pertain to the pay of certain officers and other members of the Defence Forces, effective from specified dates. Regulation 1 replaces the pay rates listed in the original table with new rates applicable to various ranks and roles across the Navy, Army, and Air Force. The new pay rates are based on the rank and years of service, ranging from Second Lieutenant to Major-General, among others. These regulations impose specific financial obligations on the Defence Force, detailing the annual pay rates for various appointments and ranks within the Navy, Army, and Air Force. They also specify the pay rates for female officers, medical and dental officers, chaplains, and members undergoing training. For example, Regulation 4 lists the pay rates for male officers other than those specified in the table or those described in Schedules 2, 3, and 4, with rates varying according to rank and years of service. Similarly, Regulations 7 and 8 detail the pay rates for female officers, medical and dental officers, chaplains, and members undergoing training, with different rates for different ranks and service durations. The Regulations do not explicitly mention offences, penalties, or consequences for non-compliance. However, it can be inferred that failure to adhere to these pay rates could result in legal consequences under the Defence Act 1903, the Naval Defence Act 1910, and the Air Force Act 1923, potentially including disciplinary action and financial penalties. These Acts generally provide for penalties for breaches of regulations, which may include fines or other sanctions as prescribed by law. The exact penalties would depend on the specific circumstances and the relevant provisions of the primary Acts.
