Overview
The Statutory Rules 1979 No. 83, enacted on 31 May 1979, is a legislative instrument made under the Defence Act 1903, the Naval Defence Act 1910 and the Air Force Act 1923 by the Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council. This regulation was established to amend the Defence Force (Reserves) (Financial) Regulations, specifically focusing on the pay of members other than officers or trainees. The objective of these amendments was to update and refine the eligibility criteria for financial benefits related to reserve members' training, thereby ensuring the provisions align with the evolving requirements of military service. The regulation reflects an effort to streamline the administrative processes and improve the clarity and fairness of financial provisions for reservists.
Scope and Application
The legislative instrument, Statutory Rules 1979 No. 83, constitutes a regulation made under the Defence Act 1903, the Naval Defence Act 1910, and the Air Force Act 1923. This regulation pertains to the financial arrangements for members of the defence force, specifically addressing the pay of members who are not officers or trainees. The regulation modifies the Defence Force (Reserves) (Financial) Regulations, affecting individuals who have completed training for their category of employment or prospective employment after 1 July 1975. This legislative instrument applies nationally, impacting all members of the defence force reserves across Australia, and is enforced within the jurisdiction of the Commonwealth. The regulation does not specify any exclusions, exemptions, or thresholds within its text, though it is understood that the overarching acts and other subordinate instruments may contain such provisions. The regulation extends the application by amending the existing financial regulations, which may be further detailed or modified through subsequent legislative instruments.
Key Provisions
The key operative sections of this regulation concern the amendments to the Defence Force (Reserves) (Financial) Regulations, specifically altering the conditions under which reservists are eligible for pay. Regulation 8(2) has been amended to modify the requirements for reservists to be eligible for pay. Sub-regulation (2)(b) now requires that reservists must complete training for their category of employment or prospective employment after 1 July 1975 to be eligible for pay. Additionally, sub-regulation (2)(c) has been altered to remove the requirement for reservists to undergo a test before being eligible for pay, replacing it with the condition that they must complete training after a certain date. Finally, sub-regulation (2)(d) has been omitted entirely, streamlining the eligibility criteria for reservists' pay.
The obligations and requirements imposed by these amendments are primarily concerned with the timing and nature of the training reservists must complete to be eligible for pay. Reservists must ensure they complete their training after 1 July 1975 and that this training is relevant to their category of employment or prospective employment. There is no longer a requirement for reservists to pass a test before being eligible for pay, simplifying one aspect of the eligibility criteria. These changes aim to ensure that reservists are adequately trained and ready for their roles, while also streamlining the administrative processes involved in determining pay eligibility.
Any breaches of the requirements outlined in these regulations could potentially lead to reservists being deemed ineligible for pay, with the associated financial implications. Although the regulation does not explicitly detail criminal or civil penalties for non-compliance, failure to meet the specified training and employment criteria could result in administrative consequences within the Defence Force. The precise consequences would depend on the context and severity of the non-compliance, but it is clear that adhering to the stipulated training and employment conditions is crucial for reservists seeking pay.
In summary, the regulation provides clear amendments to the eligibility criteria for reservists' pay, emphasising the importance of completing relevant training after a specific date. By removing certain administrative hurdles, the regulation aims to streamline the process for reservists while ensuring they are adequately prepared for their roles. Non-compliance with these requirements could lead to administrative penalties, underscoring the importance of adhering to the stipulated conditions.
