Overview

The Defence Force (Reserves) (Financial) Regulations 2 (Amendment) Interim Determination 1981 was enacted to address issues related to the financial aspects of service for members of the Defence Force Reserves. The regulation was made under the authority of the Defence Amendment Act 1979 by the Minister of State for Administrative Services, acting on behalf of the Minister of State for Defence. The objective of this amendment was to refine the criteria for calculating financial entitlements for reservists, specifically addressing their service duration and ranks within the Defence Force structure. This adjustment aimed to ensure that reservists receive appropriate compensation for their service, aligning with their ranks and the duration of their service. The Interim Determination was notified in the Commonwealth of Australia Gazette on 28 August 1981, reflecting the intent to swiftly implement the necessary changes to the existing regulations.

Scope and Application

The Defence Force (Reserves) (Financial) Regulations 2 (Amendment) Interim Determination, made under section 12 of the Defence Amendment Act 1979, applies to members of the Defence Force Reserves and specifically pertains to the financial aspects of their service. This amendment to Regulation 12 extends the definition of service in a rank by including service in an arm of the Defence Force or in a rank opposite to that rank in specified columns of the Defence Force (Salaries) Regulations. This amendment aims to clarify and expand the conditions under which reservists’ service is recognised and compensated, thereby ensuring that their financial entitlements are accurately reflected. The amendment applies on a national level, as it is an interim determination made under Commonwealth legislation, and is subject to further legislative refinement or repeal as deemed necessary by the relevant authorities. The regulation does not explicitly state any exclusions or thresholds, but its application is inherently limited to reservists within the specified Defence Force ranks and arms.

Key Provisions

The main operative sections of the Statutory Rules 1981 No. 2371 Defence Force (Reserves) (Financial) Regulations 2 (Amendment) pertain to the modification of Regulation 12. Specifically, sub-regulation (7) is amended in two ways. Firstly, the phrase “in an arm of the Defence Force” is inserted after “full-time service”, broadening the scope of where a member can serve. Secondly, the phrase “, or in a rank that is opposite to that rank in column 1, 2 or 3 of Schedule 1, 2, 4, 5, 6 or 7 of the Defence Force (Salaries) Regulations” is inserted after “30 days in that rank”, further clarifying the ranks that may be considered for this regulation. These changes aim to ensure that the financial provisions for reserve members are accurately applied across different contexts within the Defence Force. The obligations and requirements imposed by these regulations on the parties involved primarily concern the financial treatment of reserve members within the Defence Force. The amendments to Regulation 12 ensure that when calculating financial entitlements, the service period in a specific rank and the arm of the Defence Force where the service is rendered are considered. This includes the possibility of counting service in ranks opposite to those listed in the Defence Force (Salaries) Regulations. Such adjustments aim to provide a more comprehensive and equitable financial framework for reserve members, taking into account their diverse service conditions and contributions. The Statutory Rules 1981 No. 2371 do not explicitly outline specific offences, penalties, or civil/criminal consequences for breach within the document itself. However, it is implied that adherence to these financial regulations is crucial for maintaining the integrity and fairness of the Defence Force's financial provisions. Non-compliance with these amended regulations could potentially lead to disputes over financial entitlements, which might be resolved through administrative or legal processes. The Defence Force (Reserves) (Financial) Regulations and related statutes would govern any such proceedings, including possible recourse to penalties or corrective measures as deemed necessary by the relevant authorities. In summary, the Statutory Rules 1981 No. 2371 Defence Force (Reserves) (Financial) Regulations 2 (Amendment) provide critical adjustments to the financial provisions for reserve members within the Defence Force. By amending Regulation 12, these rules ensure that service in various ranks and arms of the Defence Force is appropriately considered for financial entitlements. While specific penalties for non-compliance are not detailed in this legislation, the importance of adherence to these financial regulations is underscored, with potential repercussions managed through established Defence Force procedures.
