3. The Defence Force (Reserves) (Financial) Regulations as amended by regulations 1 and 2 apply in relation to service by—

(a) members of the Navy and of the Army—on or after 1 April 1977; and

(b) members of the Air Force—on or after 31 March 1977.

Overview

Statutory Rules 1977 No. 81, made under the Defence Act 1903, the Naval Defence Act 1910 and the Air Force Act 1923, address the need to revise the financial regulations governing the pay and allowances of reservists within the Australian Defence Force. Enacted by the Administrator of the Government of the Commonwealth of Australia, with the advice of the Federal Executive Council, these Regulations aim to update and standardise the compensation structures for reservists across the Navy, Army, and Air Force, effective from 1 April 1977 for the Navy and Army, and 31 March 1977 for the Air Force. The policy objective is to ensure that the financial provisions are equitable and reflective of the current service conditions and responsibilities. This legislative instrument replaces and amends previous regulations to better align with the evolving nature of military service and the roles of reservists.

Scope and Application

Statutory Rules 1977 No. 81, made under the Defence Act 1903, the Naval Defence Act 1910, and the Air Force Act 1923, outlines amendments to the Defence Force (Reserves) (Financial) Regulations, specifically concerning the pay of certain officers. These regulations apply to members of the Navy, Army, and Air Force, including both officers and enlisted personnel, as well as those undergoing training, as specified in the various schedules. The regulations establish different pay rates based on rank, years of service, and specific appointments. The changes took effect on different dates, with the Navy and Army regulations applying from 1 April 1977 and the Air Force regulations from 31 March 1977. The regulations also repealed previous schedules and substituted new ones detailing pay scales for various officer ranks, including male and female officers, medical officers, dental officers, and chaplains. Additionally, the regulations cover pay for enlisted personnel, differentiating between male and female members and those undergoing training. These regulations are binding and extend to all members of the Defence Force Reserves within the Commonwealth of Australia, ensuring consistent application of financial provisions across the services.

Key Provisions

The main operative sections of these Regulations (referred to as "the Regulations") pertain to the amendment of the Defence Force (Reserves) (Financial) Regulations, which establish the pay rates for various positions within the Australian Defence Force Reserves. Specifically, Regulation 1 replaces the existing table in Regulation 4 with a new table that outlines the annual pay rates for different appointments and ranks across the Navy, Army, and Air Force, including specific positions such as Inspector-General of Reserves, Major-General, Brigadier, and various other officer and non-commissioned officer ranks (Regulation 4). Schedules 1 to 7 detail the pay rates for male and female officers, medical officers, dental officers, and chaplains, as well as for male and female members undergoing training (Regulation 7 and 8). These Regulations impose specific obligations on the Australian Defence Force Reserves, including the requirement to adhere to the pay rates outlined in the amended Regulations and Schedules. This includes ensuring that members of the Navy, Army, and Air Force Reserves receive the correct pay according to their rank, experience, and specific role (Regulation 3). Additionally, the Regulations specify the effective date of these amendments, requiring compliance from 1 April 1977 for Navy and Army members and from 31 March 1977 for Air Force members (Regulation 3). There are no explicit offences, penalties, or consequences for breach stated within these Regulations. However, non-compliance with the stipulated pay rates could potentially lead to disputes or grievances from members regarding their remuneration, which might be addressed through internal Defence Force grievance mechanisms or legal action. The absence of specific penalties in these Regulations suggests that any enforcement or redress would likely be pursued through the Defence Force's internal administrative or disciplinary processes rather than through criminal or civil law.
