Overview

The Defence Force (Entry Upon and Use of Land—Woomera Prohibited Area) Authorisation 2014 was enacted to provide a clear legal framework for the Australian Defence Force to conduct operations on specific land areas necessary for the testing of war material. This authorisation was introduced to address the need for a streamlined process to allow for such operations, particularly in areas deemed critical for the defence and safety of Australia. The enacting body was David Johnston, the Minister for Defence, and the policy objective was to ensure that the Defence Force could effectively carry out operations for the testing of war material in the designated areas, ensuring national security and compliance with regulatory requirements. This authorisation replaced an earlier authorisation from 2007, aligning with the current legislative framework and operational needs.

Scope and Application

The Defence Force (Entry Upon and Use of Land—Woomera Prohibited Area) Authorisation 2014 is an instrument under regulation 34 of the Defence Force Regulations 1952, issued by the Minister for Defence, David Johnston. This authorisation applies to the specific area of land in South Australia, identified on the plan numbered G.P. 249/1989, sheet 2, dated 1 September 2014, which is deemed necessary or expedient for the safety or defence of Australia to conduct operations for the testing of war material. The authorisation allows for entry upon and use of this land on behalf of the Commonwealth for the specified purpose, thereby providing the legal framework for defence operations within this delineated area. The authorisation repeals the previous Defence Force (Entry Upon and Use of Land) Authorisation 2007, ensuring that the current legislation is the governing instrument for the activities in the designated area.

Key Provisions

The Defence Force (Entry Upon and Use of Land—Woomera Prohibited Area) Authorisation 2014 provides the legal basis for the Commonwealth to enter upon and use a specific area of land in South Australia for the purpose of testing war material. The area in question is delineated on plan G.P. 249/1989, sheet 2, dated 1 September 2014, which is deposited in the General Registry Office at Adelaide. This authorisation is made under regulation 34 of the Defence Force Regulations 1952 and comes into effect on the day it is made. The primary purpose of this authorisation is to enable the Commonwealth to carry out operations for testing war material in a designated area that is deemed necessary or expedient for the safety or defence of Australia. The authorisation imposes obligations on the Commonwealth to ensure that any activities carried out under this authorisation are conducted in accordance with the specified purpose, which is the testing of war material. It is also necessary for the Commonwealth to ensure that these activities do not infringe upon the rights of landholders or other stakeholders in the area. Additionally, the authorisation mandates that the Commonwealth adhere to any relevant environmental, safety, and security regulations that may apply to the area. Compliance with these regulations is essential to mitigate any potential adverse effects on the environment and to ensure the safety of personnel and the public. Failure to comply with the terms of this authorisation may result in legal consequences. While the specific penalties for breach are not detailed in the authorisation itself, breaches of similar authorisations under the Defence Force Regulations 1952 can lead to both civil and criminal penalties. Civil penalties may include fines, while criminal penalties could potentially involve imprisonment, depending on the severity and intent behind the breach. The exact penalties would be determined in accordance with the applicable laws and regulations governing the Defence Force and its operations. The Defence Force (Entry Upon and Use of Land—Woomera Prohibited Area) Authorisation 2014 also includes a schedule that repeals the Defence Force (Entry Upon and Use of Land) Authorisation 2007 (No. 1). This repeal indicates that the earlier authorisation is no longer in effect, and the 2014 authorisation now governs the entry upon and use of the specified land for the purpose of testing war material.
