Overview

The Defence Determination, Conditions of service (Operation COVID-19 ASSIST Allowance) Commencement Instrument 2024 (No. 1) was enacted to address the need for providing financial support to certain members of the Defence Force in response to the COVID-19 pandemic. This instrument was made under the authority of section 4.12.4 of the Defence Determination 2016/19, Conditions of service. The policy objective is to ensure that eligible members receive the Operation COVID-19 ASSIST Allowance, thereby providing them with financial assistance during the pandemic. The instrument is set to commence upon registration on the Federal Register of Legislation and specifies that the allowance is payable from 14 February 2024 to members who fall within the class of members outlined in Schedule 1.

Scope and Application

The Defence Determination, Conditions of service (Operation COVID-19 ASSIST Allowance) Commencement Instrument 2024 (No. 1) applies to a specific class of members within the Australian Defence Force who are assigned particular PMKeyS numbers as detailed in Schedule 1 of the instrument. This instrument is made under the authority of section 4.12.4 of Defence Determination 2016/19, Conditions of service, and it outlines the commencement and payment details of the Operation COVID-19 ASSIST Allowance. The allowance is effective from 14 February 2024 and is payable to members who fall within the specified class, which is defined by the PMKeyS numbers listed in the schedule. This instrument operates under Commonwealth jurisdiction and its provisions apply nationally across Australia. The instrument itself does not specify any exclusions or exemptions, but the allowances and conditions may be further detailed or adjusted through subordinate instruments or Defence policies.

Key Provisions

The main operative sections of the Defence Determination, Conditions of service (Operation COVID-19 ASSIST Allowance) Commencement Instrument 2024 (No. 1) (the "Instrument") pertain to the commencement of the allowance and the class of members eligible for this allowance. Section 2 states that the Instrument commences upon registration on the Federal Register of Legislation. Section 4 outlines that the Operation COVID-19 ASSIST Allowance is payable from 14 February 2024 to members who fall within the specified class of members detailed in Schedule 1 of the Instrument. The Instrument imposes specific obligations and requirements on the parties it governs. It mandates that the Operation COVID-19 ASSIST Allowance is payable only to those members who are assigned one of the PMKeyS numbers listed in Schedule 1 of the Instrument. This ensures that the allowance is distributed accurately and only to eligible members. The members who fall under the specified PMKeyS numbers are the only ones eligible to receive this allowance, which is a crucial aspect of compliance with the Instrument. Under this Instrument, there are no explicit provisions detailing offences, penalties, or civil/criminal consequences for breach. However, it is implied that failure to comply with the conditions specified in the Instrument, such as distributing the allowance to ineligible members, could lead to administrative actions. Such actions might include the recovery of improperly paid allowances and potential disciplinary measures against those responsible for the breach. It is important for all involved to adhere strictly to the eligibility criteria to avoid any repercussions.
