The Defence Determination, Conditions of service (Operation COVID-19 ASSIST Allowance) Commencement Instrument 2023 (No. 5) applies to specific members within the Australian Defence Force (ADF) who are assigned particular PMKeyS numbers as detailed in Schedule 1 of the instrument. This determination comes into effect upon registration on the Federal Register of Legislation, and it is made under section 4.12.4 of Defence Determination 2016/19, Conditions of service. The allowance is payable to eligible members from 15 March 2023, providing financial support in response to the challenges posed by the COVID-19 pandemic. Key Provisions

The main sections of the Defence Determination, Conditions of service (Operation COVID-19 ASSIST Allowance) Commencement Instrument 2023 (No. 5) detail the commencement and payment provisions of the allowance. The instrument is named as such in section 1, and it commences on registration on the Federal Register of Legislation, as stated in section 2. Section 3 establishes the authority under which this instrument is made, specifically section 4.12.4 of Defence Determination 2016/19, Conditions of service. The critical provision in section 4 specifies that the Operation COVID-19 ASSIST Allowance is payable to members who fall within the class of members outlined in Schedule 1, from 15 March 2023. The obligations and requirements imposed by this Act primarily focus on the payment of the allowance. Members of the Australian Defence Force (ADF) who fall within the specified PMKeyS numbers listed in Schedule 1 are entitled to the Operation COVID-19 ASSIST Allowance. This allowance is designed to provide financial support to eligible members who may have been affected by the COVID-19 pandemic. The Act mandates that the Department of Defence ensure the timely payment of this allowance to the eligible members, starting from 15 March 2023. The Act does not explicitly outline specific offences, penalties, or consequences for breach in its text. However, the failure to comply with the provisions of this instrument, such as not paying the allowance to eligible members, could potentially lead to administrative or disciplinary actions under the Defence Force Discipline Act 1982, depending on the circumstances and the discretion of the relevant authorities. Additionally, there may be implications for the responsible officials within the Department of Defence, which could include internal reviews, investigations, and potential repercussions for non-compliance with Defence Determinations and conditions of service.
