Overview

The Defence Determination, Conditions of Service Amendment (Employment Categories Salary Non-reduction) Determination 2019 was enacted to address the need for a salary non-reduction period for certain members of the Australian Defence Force (ADF). This Determination was made under section 58B of the Defence Act 1903 and is subject to the interpretation principles in the Acts Interpretation Act 1901. The policy objective is to provide salary non-reduction for members in specific employment categories, ensuring they are remunerated at their current rate until they have the opportunity to obtain relevant training to advance their salaries. The Defence Force Remuneration Tribunal, Navy, Army and Air Force were consulted in the making of this Determination, and it is compatible with the human rights and freedoms recognised in the international instruments listed in the Human Rights (Parliamentary Scrutiny) Act 2011. The Determination introduces salary non-reduction periods for members of the Army Reserve Construction Engineers who are carpenters, electricians, or plumbers; members of the Army who are Geomatic Technicians; and members of the Navy who are Electronic Warfare Submarine sailors. These periods allow affected members to maintain their current salary levels until specific end dates, providing them with sufficient time to gain the necessary training to advance their salaries. The retrospective effect of certain provisions ensures that the affected members are not disadvantaged. The commencement date of this Determination is 14 November 2019.

Scope and Application

The Defence Determination, Conditions of Service Amendment (Employment Categories Salary Non-reduction) Determination 2019 (No. 33) amends Defence Determination 2016/19, Conditions of Service, made under section 58B of the Defence Act 1903. This Determination applies to specific members of the Australian Defence Force (ADF) who are engaged in particular employment categories. It establishes a salary non-reduction period to ensure that these members are remunerated at their current rate of salary until they have the opportunity to complete the necessary training to advance to a higher rate of salary. The affected members include Army Reserve Construction Engineers who are carpenters, electricians, or plumbers; Army Geomatic Technicians; and Navy Electronic Warfare Submarine sailors. The salary non-reduction periods vary depending on the employment category and pay grade, ranging from 28 November 2019 to 27 November 2024, 1 July 2018 to 30 June 2021, and 24 January 2019 to 23 January 2021, respectively. This Determination does not prejudice the rights of any person (other than the Commonwealth) nor does it impose any liability on such a person. The Determination is compatible with human rights as it advances the protection of just and favourable conditions of work, as recognised under Article 7 of the International Covenant on Economic, Social and Cultural Rights.

Key Provisions

The main operative sections of this Determination (sections 2 to 5) amend the Defence Determination 2016/19, Conditions of service (the Principal Determination) by introducing a salary non-reduction period for specific employment categories within the Australian Defence Force (ADF). Specifically, this Determination provides a salary non-reduction period for Army Reserve Construction Engineers who are carpenters, electricians, or plumbers (section 2); Army Geomatic Technicians (sections 3 and 4); and Navy Electronic Warfare Submarine sailors (section 5). These members will be remunerated at their current rate of salary until specified end dates, providing them with sufficient time to obtain the relevant training required to advance to a higher rate of salary. The obligations and requirements imposed by this Determination on the ADF and affected members include ensuring that members within the specified employment categories receive their current remuneration levels until the specified end dates. The ADF must implement these salary non-reduction periods as outlined in the amended Annex 3.2.B of the Principal Determination. Affected members must maintain their qualifications and skills and complete the necessary training to advance to higher pay grades within the specified timeframes. This Determination does not explicitly outline offences, penalties, or consequences for breaches of its provisions. However, as a disallowable legislative instrument, any non-compliance with this Determination could potentially be subject to review and disallowance by Parliament under the Legislation Act 2003. Additionally, failure to adhere to the salary non-reduction periods may result in legal challenges or disputes regarding remuneration, which could be resolved through the Defence Force Remuneration Tribunal or other relevant legal forums. The retrospective effect of the amendments ensures that affected members are not prejudiced and that their rights are protected.
