Overview

The Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025 was enacted to provide clarity and standardisation in the forms required for various actions under the Defence Determination 2016/19, Conditions of service. This legislation, issued under the authority of Brigadier Kirk Lloyd, Director General, People Policy and Employment Conditions, within the Defence People Group, aims to ensure that Defence personnel and members have access to the correct forms for their needs, thereby streamlining administrative processes. The instrument revokes the previous Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025 and lists approved forms for actions such as applying for recognition of resident family with special needs, applying for leave, and applying for education assistance. The approved forms are either available in the Defence Personnel Management Key Solutions self-service system or are prescribed forms identified by specific form identifiers. This notifiable instrument is designed to support the efficient and effective administration of Defence personnel matters by ensuring that the correct forms are used for specific actions. The enactment of this instrument addresses the need for a standardised and accessible set of forms, facilitating better service delivery and compliance with Defence policies. The policy objective is to enhance operational efficiency by providing clear guidelines on the forms required for various administrative actions within the Defence force.

Scope and Application

The Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025, issued under the authority of Brigadier Kirk Lloyd, Director General of People Policy and Employment Conditions within the Defence People Group, outlines the approved forms for various actions specified under Defence Determination 2016/19, Conditions of service. This instrument, which came into effect on 11 September 2025, serves to replace its predecessor, Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025. It specifies the approved forms for actions such as applying for recognition of resident family with special needs, applying for recognition as an accompanied or unaccompanied resident family, and applying for recognition of a de facto relationship, among others. These forms are either available through the Defence Personnel Management Key Solutions self-service system or prescribed forms identified in the table. The instrument provides a clear framework for Defence personnel to follow when submitting applications or notifications related to their conditions of service.

Key Provisions

The Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025, signed by Brigadier Kirk Lloyd, Director General, People Policy and Employment Conditions, sets out the approved forms required for various Defence-related actions as stipulated under the Defence Determination 2016/19. The instrument, which commenced on 11 September 2025, revokes the previous Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025 and provides a comprehensive list of approved forms for different Defence-related actions. These actions include applying for recognition of resident family with special needs, applying for recognition as accompanied or unaccompanied resident family, applying for recognition of a CDF recognised partner or a de facto relationship, and various other Defence-related applications and notifications. The obligations imposed by this instrument require Defence personnel to use the specified approved forms when undertaking certain actions, as listed in the table within the instrument. For example, Section 1.3.6 requires the use of AC832 – Application for Special Needs Assistance for applying for recognition of the member’s resident family with special needs. The Defence Personnel Management Key Solutions self-service system is the primary source for these forms, but if unavailable, Defence members must use the forms prescribed in column C of the table, such as AE681 – ADF Categorisation Change and Application to Live In/Live Out for applying for recognition as accompanied or unaccompanied resident family. Breaches of the requirements set forth in this instrument can lead to various consequences. While the instrument itself does not explicitly state the penalties for non-compliance, Defence members who fail to use the approved forms when required may face administrative or disciplinary actions. For example, submitting an application using an unapproved form for an action that requires a specific approved form could result in the application being rejected or delayed. This could potentially impact the Defence member's entitlements or benefits, depending on the nature of the application. The Defence Force Administrative Appeals Tribunal (DFAT) may also be involved in resolving disputes related to the use of approved forms. In summary, the Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025 provides a list of approved forms for various Defence-related actions, replacing the previous instrument. Defence personnel must use these approved forms when undertaking the specified actions, and failure to do so may result in administrative or disciplinary consequences. While the instrument does not explicitly state the penalties for non-compliance, Defence members who do not use the approved forms risk having their applications rejected or delayed, potentially impacting their entitlements or benefits.
