Overview

The Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025, enacted on 5 June 2025, serves to provide clarity and standardisation in the administrative processes within the Australian Defence Force (ADF). This instrument was introduced to address the need for a streamlined and efficient process for various applications and notifications required under the Defence Determination 2016/19, Conditions of service. It was enacted by Sarah Kate McGregor, Acting Director General, People Policy and Employment Conditions, Defence People Group, under the authority vested in the Defence Determination 2016/19. The policy objective is to ensure that all actions under the Defence Determination 2016/19 are conducted using approved forms, thereby enhancing accuracy, efficiency, and compliance in the handling of ADF member benefits and entitlements. This notifiable instrument lists specific approved forms for various actions, such as applying for recognition of resident family with special needs, applying for education assistance, and claiming compensation for leave cancellation. The approved forms are either available through the Defence Personnel Management Key Solutions self-service system or prescribed by specific form identifiers, ensuring that all relevant parties use the correct documentation for their applications and notifications. The instrument also revokes the previous Defence Determination 2016/19 (Approved forms) Instrument (No. 1) 2025 to maintain the most current and relevant administrative procedures.

Scope and Application

The Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025 applies to members of the Australian Defence Force (ADF) and other Defence personnel who need to undertake specific administrative actions as outlined in the Defence Determination 2016/19, Conditions of service. This instrument identifies the approved forms for various actions, such as applying for recognition of resident family with special needs, applying for health support allowance, and applying for education assistance. The geographic and jurisdictional reach of this instrument is limited to the ADF and Defence personnel within the Commonwealth of Australia. The instrument became effective on 5 June 2025 and it revokes the previous Defence Determination 2016/19 (Approved forms) Instrument (No. 1) 2025. The instrument does not specify any exclusions, exemptions, or thresholds, but it does indicate that subordinate instruments may extend or restrict its application.

Key Provisions

The Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025, specifies the approved forms required for various actions under the Defence Determination 2016/19, Conditions of service. The approved forms are designated to ensure consistency and compliance with the relevant sections of the Defence Determination. For instance, the approved form for applying for recognition of a member's resident family with special needs is AC832 – Application for Special Needs Assistance (Section 4). Similarly, the form for applying for recognition of a de facto relationship is AF084 – Recognition of a De Facto Relationship (Section 5). The obligations and requirements imposed by this instrument on the parties or entities it governs primarily involve the use of specified forms for various applications and notifications. For example, members of the Defence Force must use the Defence Personnel Management Key Solutions self-service system for actions listed in the instrument, or use the prescribed form if the system is unavailable or if no form exists in the system (Section 4). Additionally, Defence Force members must use the specified forms for actions such as applying for career transition assistance, applying for various allowances, and claiming compensation resulting from the cancellation or recall of leave (Sections 7, 8, and 15). Failure to comply with the requirements outlined in the Defence Determination 2016/19 (Approved forms) Instrument (No. 2) 2025 may result in civil or administrative consequences. However, the specific penalties or consequences for non-compliance are not detailed within the text of the instrument. It is important to note that compliance with these forms and requirements is crucial for ensuring the proper administration of benefits and services within the Defence Force.
