Overview

The Defence Determination 2016/19 (Approved forms) Instrument 2024 (No. 2) was enacted on 7 November 2024 by Brigadier Kirk Lloyd, the Director General of People Policy and Employment Conditions within the Defence People Group. This instrument was introduced to address the need for standardised and approved forms for various actions related to Defence personnel under the Defence Determination 2016/19, Conditions of service. The policy objective is to streamline and formalise the process by which Defence personnel can submit applications and notifications by providing specific forms for each action, ensuring consistency and compliance with Defence regulations. This notifiable instrument revokes its predecessor, Defence Determination 2016/19 (Approved forms) Instrument 2024 (No. 1), and establishes a comprehensive list of approved forms for actions ranging from applying for recognition of resident family with special needs to applying for education assistance, thereby ensuring that all Defence personnel have access to the correct forms for their specific needs.

Scope and Application

The Defence Determination 2016/19 (Approved forms) Instrument 2024 (No. 2) applies to Defence personnel and their families, specifically in relation to the approval of forms for various actions as stipulated under section 1.3.1 of the Defence Determination 2016/19, Conditions of service. The instrument sets forth the approved forms for actions such as applying for recognition of a resident family with special needs, recognition of a de facto relationship, and applying for various allowances and benefits. It specifies that the forms must either be sourced from the Defence Personnel Management Key Solutions self-service system or, in the absence of such a form or availability of the system, a prescribed form must be used, as detailed in the table provided in the instrument. The instrument commenced on 7 November 2024 and it revokes the Defence Determination 2016/19 (Approved forms) Instrument 2024 (No. 1). The application of this instrument is confined to the Commonwealth jurisdiction and primarily concerns Defence personnel, their families, and the Defence Department. There are no exclusions or exemptions explicitly stated in the instrument itself, but the application of the forms may be further detailed in subordinate instruments.

Key Provisions

The Defence Determination 2016/19 (Approved forms) Instrument 2024 (No. 2) sets out the approved forms for various actions within the Defence force, as per section 1.3.1 of the Defence Determination 2016/19, Conditions of service. These forms are designed to streamline the process for Defence personnel to apply for specific benefits, recognitions, or to make various requests related to their service. For example, an application for recognition of a member's resident family with special needs requires the use of form AC832 – Application for Special Needs Assistance, while an application for recognition as an unaccompanied resident family requires form AE681 – ADF Categorisation Change and Application to Live In/Live Out. These forms are specified in column C of the table within the instrument, where applicable. The instrument imposes specific obligations on Defence personnel and administrative staff to use the approved forms when making certain applications or requests. For example, when applying for recognition of a de facto relationship, the appropriate form AF084 – Recognition of a De Facto Relationship must be used. Similarly, when applying for Career Transition assistance, the form AC853-3 – Defence Force Transition Program Application must be completed. Failure to use the correct form could result in delays or rejection of the application, impacting the member's ability to receive the requested benefits or recognitions. The Defence Determination 2016/19 (Approved forms) Instrument 2024 (No. 2) does not explicitly outline specific offences, penalties, or consequences for breaches of the requirements to use approved forms. However, it is implied that non-compliance with the specified forms could lead to administrative delays or the rejection of applications, which could have practical consequences for Defence personnel seeking benefits or recognitions. While the instrument itself does not state maximum penalties, it is within the broader Defence administrative framework where further consequences for non-compliance might be addressed, such as through internal Defence policies or procedures.
