Overview

The Defence Determination 2016/19 (Approved Forms) Instrument 2023 (No. 2) was enacted to streamline and standardise the forms used for various Defence personnel administrative actions, in line with the Defence Determination 2016/19. This instrument, issued by Michael Ian McCulloch, Acting Assistant Secretary, People Policy and Employment Conditions, under the authority of the Defence Determination 2016/19, aims to ensure that all necessary applications and notifications are made using approved forms, thereby maintaining consistency and efficiency in Defence operations. The instrument revokes all previous forms and sets forth new approved forms for actions such as applying for recognition of a resident family with special needs and applying for education assistance. This change is intended to address any gaps in the previous administrative procedures, ensuring that all Defence personnel are using the correct and most up-to-date forms for their respective applications. This instrument was issued by the Australian Government and is part of the ongoing efforts to maintain efficient and effective administrative practices within the Defence sector. The policy objective is to ensure that all forms used in Defence personnel management are standardised and approved, facilitating smoother processing of applications and reducing the risk of errors or omissions. By specifying the approved forms for various actions, the Defence Determination 2016/19 (Approved Forms) Instrument 2023 (No. 2) helps to ensure that all Defence personnel are using the correct documentation, thereby enhancing the overall efficiency and effectiveness of Defence administrative processes.

Scope and Application

Defence Determination 2016/19 (Approved forms) Instrument 2023 (No. 2) outlines specific approved forms for various actions and benefits under Defence Determination 2016/19, Conditions of service. This instrument applies to members of the Australian Defence Force (ADF) and Defence personnel, governing the conditions under which certain forms must be used for actions such as applying for recognition of resident families with special needs, applying for health support allowance, and claiming compensation for the cancellation or recall of leave. This instrument's geographic and jurisdictional reach is limited to the Australian Defence Force, including both full-time and reserve members. The approved forms are applicable nationwide and are intended to ensure consistency and compliance in the processing of benefits and services. The instrument revokes all previous instruments made under section 1.3.5A of Defence Determination 2016/19, Conditions of service as in force immediately before 1 July 2023. This means that any previously approved forms not listed in this instrument are no longer valid, thereby streamlining the application and processing procedures within the ADF.

Key Provisions

The Defence Determination 2016/19 (Approved forms) Instrument 2023 (No. 2) (the Instrument) sets out the approved forms for certain actions related to the conditions of service within the Defence force. The forms are designed to standardise the process for Defence personnel to apply for various benefits, recognitions, and allowances, as well as to notify absences or claim compensation. The approved forms include those available through the Defence Personnel Management Key Solutions self-service system and specific forms prescribed for particular actions, such as applying for recognition of a de facto relationship or claiming compensation for cancelled leave (sections 1, 2, 3, and 4). The Instrument imposes obligations on Defence personnel to use the approved forms for the specified actions. This includes using the Defence Personnel Management Key Solutions self-service system where available or the prescribed forms listed in the Instrument. The approved forms ensure that applications and notifications are completed in a manner consistent with Defence policies and procedures, facilitating the processing of benefits and allowances. Defence personnel must adhere to the forms specified for each action, as outlined in the table in the Instrument (section 4). Failure to use the approved forms for the specified actions may result in the application or notification not being processed or recognised by the Defence force. While the Instrument does not explicitly state penalties for non-compliance, the use of non-approved forms could lead to delays in processing or the rejection of the application. Defence personnel must ensure they use the correct form as specified to avoid any potential issues with their application or notification (section 4).
