Overview

Defence Determination 2016/19 (Approved forms) Instrument 2022 (No. 3) was enacted to standardise and streamline the process for Defence personnel to submit various applications and claims by providing approved forms for specific actions. This determination addresses the need for uniformity in the documentation process, ensuring that all required information is captured consistently and efficiently. The enacting body, Michael McCulloch, Acting Assistant Secretary, People Policy and Employment Conditions, Defence People Group, aims to enhance the administration of Defence personnel services. This instrument revokes all previous instruments under section 1.3.5A of Defence Determination 2016/19, Conditions of service, and introduces new approved forms for actions such as applying for recognition of a dependant with special needs, applying for career transition assistance, and applying for health support allowance. The policy objective is to provide clear and accessible forms to facilitate the processing of various applications and claims by Defence personnel.

Scope and Application

The Defence Determination 2016/19 (Approved forms) Instrument 2022 (No. 3) is a notifiable instrument designed to regulate the forms approved for various applications and notifications within the Defence Force. This instrument applies to Defence Force members and their dependants, as well as relevant Defence Force offices and entities responsible for processing these applications and notifications. It serves to standardise and approve the specific forms required for actions such as applying for recognition of a dependant with special needs, applying for health support allowance, or notifying absence from car parking location to cease contribution, among others. The instrument commences on the day after its registration and revokes all previous instruments made under section 1.3.5A of Defence Determination 2016/19. The instrument’s reach is limited to Defence Force members and related personnel, ensuring that all actions and notifications comply with the approved forms listed within the instrument.

Key Provisions

The Defence Determination 2016/19 (Approved forms) Instrument 2022 (No. 3) establishes the approved forms required for various actions under Defence Determination 2016/19, Conditions of service (section 1). The instrument specifies that it commences on the day after its registration (section 2). Furthermore, it revokes all previous instruments made under section 1.3.5A of Defence Determination 2016/19, Conditions of service (section 3). The approved forms for actions listed in column A of the table in section 4 include either the form available in the Defence Personnel Management Key Solutions self-service system or, in certain circumstances, the form prescribed in column C (section 4). The obligations imposed by this instrument require that members of the defence force use the specified forms when applying for various benefits and services, such as recognition of a dependant with special needs, de facto relationships, or career transition assistance (section 4). If the Defence Personnel Management Key Solutions self-service system is not available to the member or there is no form available for the benefit, the prescribed form in column C must be used (section 4). The Defence Determination 2016/19 (Approved forms) Instrument 2022 (No. 3) ensures that the correct forms are used for different applications, streamlining the process for members and maintaining consistency in documentation. Breach of this instrument may result in administrative consequences, such as delays in processing applications or denial of benefits. However, the instrument does not explicitly outline specific offences, penalties, or civil/criminal consequences for breach. It is important for members of the defence force to adhere to the requirements set out in this instrument to ensure a smooth and efficient application process. Failure to comply with the approved forms may lead to complications and affect the timely provision of benefits and services.
