Overview

The Defence Determination 2016/19 (Approved forms) Instrument 2022 (No. 2) was enacted to address the need for standardised forms for various applications and notifications within the Australian Defence Force, specifically under the Defence Determination 2016/19, Conditions of service. This instrument, which commenced on the day after its registration, was made by Colonel Kirk Lloyd, Acting Assistant Secretary, People Policy and Employment Conditions, within the Defence People Group. The policy objective of this instrument is to ensure consistency and efficiency in the processing of various applications and notifications by providing approved forms for specific actions as listed in the instrument. This determination revokes all previous instruments made under the same section, streamlining the forms used for Defence personnel.

Scope and Application

The Defence Determination 2016/19 (Approved forms) Instrument 2022 (No. 2) applies to the Defence Force personnel and members of the Australian Defence Force who require various administrative processes to be completed. This instrument sets out the approved forms that must be used for specific actions related to service conditions, benefits, and allowances as prescribed in Defence Determination 2016/19. The scope of this instrument is confined to the Defence Force and does not extend to the general public or other governmental sectors. The approved forms listed in the instrument are applicable across all Defence Force activities and are effective from the day after its registration, effectively revoking all previous instruments related to approved forms under Defence Determination 2016/19. The approved forms encompass a range of applications, from recognition of dependants with special needs to applications for various allowances and assistance, ensuring that all necessary documentation is completed using the specified forms.

Key Provisions

The Defence Determination 2016/19 (Approved forms) Instrument 2022 (No. 2) (the Instrument) provides a list of approved forms for various actions required by Defence personnel, as stipulated in section 1.3.5A of Defence Determination 2016/19, Conditions of service. This document identifies the specific forms to be used for different applications and notifications, as detailed in the table within section 4 (Approved forms). For instance, an application for recognition of a dependant with special needs must use the form identified as AC832 (section 4(1)). Conversely, if Defence Personnel Management Key Solutions self-service system is not available, or if there is no relevant form within that system, the form prescribed in Column C must be used (section 4(a)(i) and (ii)). The Instrument imposes obligations on Defence personnel to use the approved forms when submitting applications or notifications as listed. Failure to use the correct form could lead to delays or rejections in processing the applications or notifications, potentially impacting the timely receipt of benefits or services. Defence personnel must ensure they are aware of the correct forms to use for their specific circumstances and must use these approved forms to ensure their applications are processed efficiently. Breaching the requirements of the Instrument, such as using unapproved forms for mandatory actions, could lead to administrative issues. While the Instrument does not explicitly detail specific penalties or consequences for non-compliance, it is reasonable to infer that incorrect form usage could result in procedural delays or the rejection of applications. In turn, this could affect the timely provision of benefits or services to Defence personnel and their dependants. It is therefore crucial for Defence personnel to adhere to the specified forms to avoid such issues.
