Overview

The Defence Determination 2016/19 (Approved forms) Instrument 2021 (No. 3) was enacted to provide a streamlined process for Australian Defence Force (ADF) members to complete various administrative actions, such as applying for recognition of dependants with special needs, applying for career transition assistance, or claiming compensation for cancelled leave. This instrument was introduced to address the need for standardised and accessible forms to facilitate these processes, improving efficiency and ensuring compliance with Defence regulations. The enactment body is the Australian Government, represented by the Assistant Secretary, People Policy and Employment Conditions within the Defence People Group. The policy objective is to ensure that ADF members have clear and accessible forms to manage their service-related administrative tasks effectively and efficiently.

Scope and Application

The Defence Determination 2016/19 (Approved forms) Instrument 2021 (No. 3) is a notifiable instrument that applies to Australian Defence Force (ADF) members and their dependants who seek to initiate specific actions related to their service conditions, as outlined in Defence Determination 2016/19. This instrument specifically governs the approved forms that must be used for various actions, including applying for recognition of dependants with special needs, medical absence from duty, or claiming compensation from cancelled or recalled leave. The instrument came into effect on the day after its registration and revokes all previous instruments made under section 1.3.5A of Defence Determination 2016/19. The instrument provides a list of actions that require the use of specific forms, either from the Defence Personnel Management Key Solutions self-service system or prescribed forms in column C of the table, depending on the availability of the system and the nature of the benefit or service requested.

Key Provisions

The Defence Determination 2016/19 (Approved forms) Instrument 2021 (No. 3) (hereafter referred to as the Instrument) outlines the approved forms for various actions related to Defence personnel services. The Instrument commences on the day following its registration (section 2) and revokes all previous instruments made under section 1.3.5A of Defence Determination 2016/19 (section 3). Section 4 details the approved forms for different actions, such as applying for recognition of a dependant with special needs or a de facto relationship, applying for career transition assistance, or applying for health support allowance. The forms are either found in the Defence Personnel Management Key Solutions self-service system or are prescribed in Column C if the self-service system is unavailable or does not list the required form. The Instrument imposes obligations on Defence personnel and the Defence Department to ensure the correct forms are used for the specified actions. For instance, when a member needs to apply for recognition of a dependant with special needs, they must use the form identified as AC832 – Application for Recognition of Member with Dependant with Special Needs, or the Defence Personnel Management Key Solutions self-service system form if available (section 4, item 1). Similarly, when a member applies for a medical absence from duty, they must use the form PM101 – Medical or Dental Fitness Advice (section 4, item 5). This requirement ensures that all applications and claims are processed in a uniform and efficient manner, facilitating timely responses to Defence personnel's needs. Failure to comply with the requirements of the Instrument may lead to delays in processing applications or claims, potentially affecting the rights and entitlements of Defence personnel. The Instrument does not explicitly outline offences, penalties, or consequences for non-compliance, but it is likely that any breach of the requirement to use the correct forms could result in administrative penalties or delays in the processing of applications. The Defence Department may also have internal disciplinary measures in place for non-compliance with procedural requirements. However, the specific penalties and consequences for breach would depend on the Defence Department's internal policies and procedures, and any applicable legislation.
