Overview

The Defence Determination 2016/19 (Approved forms) Instrument 2019 (No. 1) was introduced to provide a standardised process for Defence personnel to complete various administrative tasks related to their service. Enacted by the Assistant Secretary, People Policy and Employment Conditions, this instrument aims to streamline the forms and processes required for actions such as applying for absence, claiming compensation, or registering for the National ADF Family Health Program. By specifying the approved forms for each action, the instrument seeks to ensure consistency and efficiency in the handling of these requests, thereby improving the overall service experience for Defence members.

Scope and Application

The Defence Determination 2016/19 (Approved forms) Instrument 2019 (No. 1) applies to Defence personnel and specifically governs the approved forms for various actions as outlined in section 1.3.5A of Defence Determination 2016/19. This instrument ensures that Defence personnel can use specified forms for actions such as applying for absence, claiming compensation, or registering for the National ADF Family Health Program. The approved forms include both digital forms available through the Defence Personnel Management Key Solutions self-service system and prescribed paper forms where the self-service system is unavailable or does not support the particular action. This instrument is effective from 31 July 2019 and provides a comprehensive list of actions alongside the corresponding approved forms, ensuring that Defence personnel have the correct tools to manage their service-related requests and benefits.

Key Provisions

The main operative sections of this legislation (sections 1 to 3) establish the name of the instrument, its commencement date, and list the approved forms for various actions related to Defence personnel services. Specifically, section 1 identifies the instrument as Defence Determination 2016/19 (Approved forms) Instrument 2019 (No. 1). Section 2 sets the commencement date of this instrument as 31 July 2019. Section 3 details the approved forms that must be used for specific actions, such as applying for absence or notifying non-effective service, applying for medical absence, applying to purchase recreation leave, and so forth. Each action is linked to a related section in Defence Determination 2016/19 and specifies the appropriate form to be used. The obligations and requirements imposed by this Act on the parties or entities it governs are primarily centred around the use of approved forms for specific actions. Defence personnel must ensure they use the correct form as specified in the table within section 3 when undertaking actions such as applying for leave, claiming compensation, or updating dependant details. These approved forms must be sourced either from the Defence Personnel Management Key Solutions self-service system or, if specified, from the prescribed forms listed in Column C. Additionally, the determination allows for flexibility in form usage, for instance, when the Defence Personnel Management Key Solutions self-service system is not available to the member. The legislation outlines potential consequences for non-compliance with the specified forms and procedures. While the document does not explicitly detail offences, penalties, or civil/criminal consequences for breaches, it is implied that using unapproved forms or not following the prescribed procedures could lead to administrative issues or delays in processing requests. The approved forms are integral to maintaining the efficiency and consistency of Defence personnel management, and any deviation might result in the invalidation of an application or request, thereby impacting the member’s entitlements and benefits. In summary, this Defence Determination mandates the use of specific, approved forms for various Defence personnel actions, ensuring standardised and streamlined processing. The approved forms, detailed in section 3, are critical for compliance with Defence Determination 2016/19 and must be used as per the requirements outlined. Any failure to adhere to these specifications might result in procedural delays or the rejection of submitted applications, thus impacting the member's service-related benefits and entitlements.
