Overview

The Defence Amendment Determination, Conditions of Service Amendment, Commencement Instrument 2021 (No. 1) was enacted to rectify the commencement date for specific amendments related to the Defence Determination, Conditions of Service. This notifiable instrument was introduced to ensure that the provisions of the Defence Determination, Conditions of Service Amendment (Miscellaneous amendments) Determination 2021 (No. 16) and the Defence Determination, Conditions of Service Amendment Determination 2021 (No. 17) are implemented effectively from 14 October 2021. The instrument was issued under the authority of Fiona Louise McSpeerin, Assistant Secretary, People Policy and Employment Conditions, within the Defence People Group. The intent behind this instrument is to address any potential delays or uncertainties in the application of these amendments, ensuring that the intended policy objectives of enhancing conditions of service within the Defence force are met without disruption.

Scope and Application

The Defence Amendment Determination, Conditions of service Amendment, Commencement Instrument 2021 (No. 1) pertains to the amendment of service conditions within the Defence Force, specifically affecting the implementation of two preceding determinations. This instrument is applicable to all personnel within the Australian Defence Force, including both civilian and military members. The scope of this Act ensures that the amendments to service conditions as outlined in Item 2 of the tables in subsections 2(1) of the Defence Determination, Conditions of service Amendment (Miscellaneous amendments) Determination 2021 (No. 16) and the Defence Determination, Conditions of service Amendment Determination 2021 (No. 17) are effectively brought into force on 14 October 2021. The legislation is confined to the Australian Defence Force, thus it applies on a national level within the Commonwealth of Australia, and no exclusions or exemptions are specified within the text. The instrument extends its application through the referenced determinations, thereby integrating and enforcing the stipulated conditions of service within the Defence Force.

Key Provisions

The main operative sections of this notifiable instrument, the Defence Amendment Determination, Conditions of service Amendment, Commencement Instrument 2021 (No. 1), specify the commencement date for certain amendments to Defence determinations. Specifically, it sets the date as 14 October 2021, affecting two particular items within the Defence Determination, Conditions of service Amendment (Miscellaneous amendments) Determination 2021 (No. 16) and the Defence Determination, Conditions of service Amendment Determination 2021 (No. 17). These amendments are related to conditions of service, which include pay, allowances, and other employment-related provisions for Defence personnel. This Act imposes clear obligations on the relevant parties, primarily ensuring that all amendments to the conditions of service as outlined in the specified determinations come into effect on the fixed date of 14 October 2021. The determination ensures that Defence personnel, their representatives, and any other affected parties are aware of the new conditions and requirements that will apply from this date. It also mandates that all related documentation and communications reflect this change accurately and promptly. Failure to adhere to the commencement date and the provisions set forth in this notifiable instrument could result in non-compliance with Defence policies and regulations. While the instrument does not explicitly state penalties for breaches, non-compliance could lead to administrative or legal consequences, including potential disciplinary action for Defence personnel or entities. The precise nature of these consequences would depend on the specific circumstances and the extent of the non-compliance. The notifiable instrument is signed by Fiona Louise McSpeerin, Assistant Secretary, People Policy and Employment Conditions, Defence People Group, on 16 September 2021, giving it the force of law and requiring all parties to act in accordance with its provisions from the specified commencement date. This legal formality ensures the determination is properly executed and recognised within the Defence framework.
