Overview

The Australian Electoral Commission Aboriginal and Torres Strait Islander Act 2005 was enacted to address the need for better representation and electoral participation of Aboriginal and Torres Strait Islander peoples in Australia. The Act was introduced to provide a legislative framework aimed at enhancing the electoral rights and participation of these indigenous communities. The policy objective of the Act is to ensure that Aboriginal and Torres Strait Islander peoples have equal access to the electoral process, thereby promoting their representation in the Australian Parliament and other representative bodies. The Act was passed by the Australian Parliament and represents a commitment to recognising and addressing the unique needs and challenges faced by indigenous Australians in exercising their democratic rights. This legislative measure underscores the importance of inclusivity and equity in the electoral system, seeking to bridge the gap in political representation for these communities.

Scope and Application

The Torres Strait Regional Authority Election Rules 1996, as amended, govern the conduct of elections for the Torres Strait Regional Authority and apply to the geographic area of the Torres Strait Islands, extending the reach of the Commonwealth Electoral Act 1918 to ensure that eligible voters in this remote and unique region can participate in the electoral process. This specific declaration by the Electoral Commissioner, exercising powers under the Torres Strait Regional Authority Election Rules 2017, designates certain hospitals and specified parts of hospitals on Thursday Island as mobile polling booths for the 2020 election. This ensures that voters residing within these healthcare facilities can cast their ballots during specified times on 26 November 2020. The declaration is effective immediately upon its execution and applies solely to the electoral process for the Torres Strait Regional Authority Election, excluding other elections or voting processes.

Key Provisions

The main operative sections of the Gazette (C2020G00879) pertain to the declaration of specific hospitals and parts of hospitals as mobile polling booths for the 2020 Torres Strait Regional Authority Election. Under section 143GT of the Australian Electoral Commission Aboriginal and Torres Strait Islander Act 2005, and subrule 77(1) of the Torres Strait Regional Authority Election Rules 1996, the Electoral Commissioner, Tom Rogers, has declared the Star of the Sea Elders Village, Home and Community Care Services, and Thursday Island Hospital as polling locations on Thursday 26 November 2020. Each of these locations will serve as a polling booth for specified time periods during the day. The Act imposes specific obligations on the parties involved in the election process. The Electoral Commissioner must ensure that these declared locations are properly set up to accommodate voting activities. This includes providing necessary polling materials and ensuring the security and integrity of the voting process at these sites. The Act also mandates that these locations be open to eligible voters during the specified times, allowing them to cast their votes in a manner that is convenient and accessible. Failure to comply with the requirements set out in this declaration may result in legal consequences. While the specific offences, penalties, or consequences for non-compliance are not detailed in the text, it is understood that breaches of electoral laws can lead to civil or criminal penalties. Such penalties may include fines, imprisonment, or other legal actions as prescribed by the relevant electoral legislation. The precise penalties would be determined based on the severity of the breach and the specific provisions of the Commonwealth Electoral Act 1918 and associated rules.
