Overview

The Declaration of State of Emergency (Jervis Bay Territory) (No. 9) 2020 was enacted by the Jervis Bay Territory Emergency Management Ordinance 2015, which was established to provide for emergency management arrangements within the Jervis Bay Territory. This declaration was made under the authority of the Assistant Minister for Regional Development and Territories, NOLA MARINO, who was satisfied that an emergency was endangering or threatening to endanger the safety or health of persons in the Jervis Bay Territory to a significant and widespread extent. The primary objective of this legislation was to revoke all previous declarations of a state of emergency and to declare a new state of emergency for the whole of the Jervis Bay Territory for a period of 30 days from the date of the declaration, aiming to address the immediate safety and health concerns of the territory's residents and visitors.

Scope and Application

The Declaration of State of Emergency (Jervis Bay Territory) (No. 9) 2020, made under the Jervis Bay Territory Emergency Management Ordinance 2015, applies to the entire Jervis Bay Territory and revokes all previous declarations of a state of emergency made under the same authority. The purpose of this declaration is to address an emergency situation that is endangering, or is threatening to endanger, the safety or health of persons in the Jervis Bay Territory to a significant and widespread extent. The declaration authorises the Assistant Minister for Regional Development and Territories to implement necessary measures for a period of 30 days, beginning from the time the instrument is made. This legislation is specifically tailored to the Jervis Bay Territory, which is a unique jurisdictional area governed by the Commonwealth of Australia, and does not extend to any other state or territory within Australia. The scope of the declaration encompasses all individuals and entities within the Jervis Bay Territory and authorises actions that may be required to mitigate the effects of the emergency. The Ordinance itself may be extended or further defined through subordinate instruments to provide additional guidance on the specific measures that can be implemented during the declared state of emergency.

Key Provisions

The main operative sections of the Declaration of State of Emergency (Jervis Bay Territory) (No. 9) 2020 revolve around the declaration and management of a state of emergency in the Jervis Bay Territory, as per the Jervis Bay Territory Emergency Management Ordinance 2015. Specifically, section 15(1) of the Ordinance allows the Assistant Minister for Regional Development and Territories to declare a state of emergency when there is an imminent or existing threat to the safety or health of individuals within the Jervis Bay Territory. This declaration revokes all previous emergency declarations and sets the new state of emergency for a 30-day period, as stated in the document dated 29 September 2020. Under the Jervis Bay Territory Emergency Management Ordinance 2015, the obligations and requirements imposed on parties and entities during a declared state of emergency are primarily aimed at ensuring public safety and health. The declaration mandates that all relevant authorities and individuals comply with the directives issued under the emergency provisions. These directives may include restrictions on movement, public gatherings, and other activities that could potentially exacerbate the emergency situation. Additionally, the declaration empowers the Assistant Minister to issue orders and regulations necessary to manage the emergency effectively. The Jervis Bay Territory’s authorities are expected to enforce these measures diligently to mitigate the risks posed by the emergency. In terms of offences, penalties, or consequences for breach of the emergency provisions, the Jervis Bay Territory Emergency Management Ordinance 2015 provides a legal framework for enforcement. Any individual or entity found in violation of the emergency orders or regulations may face legal repercussions. Civil penalties may include fines, while criminal penalties could result in imprisonment, depending on the severity of the breach. The Ordinance does not specify maximum penalties in this particular declaration but typically aligns with the penalties outlined in the general emergency management legislation. It is crucial for all parties involved to adhere to the emergency directives to avoid facing these potential consequences.
