Overview

The Declaration of State of Emergency (Jervis Bay Territory) (No. 8) 2021, enacted by the Jervis Bay Territory Emergency Management Ordinance 2015, addresses an emergency situation that endangers or threatens to endanger the safety or health of persons in the Jervis Bay Territory to a significant and widespread extent. This legislation was introduced by the Jervis Bay Territory Government, with the aim of providing a legal framework to manage such emergencies effectively. The declaration revokes all previous declarations of a state of emergency made under the Ordinance and establishes a new state of emergency for a period of 30 days, beginning from the date of the declaration. This measure underscores the government's commitment to ensuring public safety and health by enabling the necessary response and management actions during the declared emergency.

Scope and Application

The Declaration of State of Emergency (Jervis Bay Territory) (No. 8) 2021, issued under the Jervis Bay Territory Emergency Management Ordinance 2015, applies to the Jervis Bay Territory and all persons and entities within its jurisdiction. This declaration is made in response to an emergency that poses a significant and widespread threat to the safety and health of individuals in the Territory. The declaration is intended to empower the authorities to take necessary measures to address the emergency effectively. The geographic scope of this Act is limited to the Jervis Bay Territory, which is a specific administrative division under Australian law, distinct from the states and territories of Australia. The Act revokes all previous declarations of a state of emergency made under the same provision of the Ordinance, thereby establishing a new and singular declaration to ensure clarity and continuity in the response efforts. The declaration is in effect for a period of 30 days from the date of issuance, providing a defined timeframe within which the emergency measures can be implemented. The application of this Act may be extended or modified through subordinate instruments, enabling the relevant authorities to adapt to the evolving nature of the emergency.

Key Provisions

The Jervis Bay Territory Emergency Management Ordinance 2015 (the Ordinance) provides mechanisms for the declaration of a state of emergency in the Jervis Bay Territory. Under subsection 15(1) of the Ordinance, the Assistant Minister for Regional Development and Territories is empowered to declare a state of emergency if it is deemed necessary to safeguard the safety and health of persons in the Jervis Bay Territory. This power was exercised by NOLA MARINO on 19 July 2021, leading to the Declaration of State of Emergency (Jervis Bay Territory) (No. 8) 2021, which revokes all previous declarations of a state of emergency and establishes a new state of emergency for a period of 30 days. The Jervis Bay Territory Emergency Management Ordinance 2015 imposes specific obligations on the Assistant Minister and other relevant authorities to ensure effective emergency management. Section 15(1) of the Ordinance requires that if a state of emergency is declared, the Assistant Minister must ensure that the necessary measures are taken to mitigate the emergency's effects. This includes coordinating with other relevant authorities and ensuring the safety and health of persons in the Jervis Bay Territory are prioritised. The declaration also triggers additional powers and responsibilities under the Ordinance, allowing for the implementation of emergency measures and the allocation of resources to address the emergency effectively. Under the Jervis Bay Territory Emergency Management Ordinance 2015, breaches of the provisions regarding the declaration of a state of emergency may result in civil or criminal consequences. The Ordinance includes provisions for enforcement and compliance, with penalties for non-compliance outlined in relevant sections. While the specific offences and penalties are detailed in other sections of the Ordinance, the overarching consequence of failing to comply with the emergency management provisions is the potential for legal action to be taken against individuals or entities that do not adhere to the declared emergency measures. The severity of penalties may vary depending on the nature and extent of the breach.
