Key Provisions
The main operative sections of the Declaration of State of Emergency (Jervis Bay Territory) (No. 5) 2022, under the Jervis Bay Territory Emergency Management Ordinance 2015, include the revocation of all previous declarations of a state of emergency (subsection 15(1)) and the declaration of a new state of emergency (subsection 15(1)). The Jervis Bay Territory Emergency Management Ordinance 2015 imposes several obligations on the parties or entities it governs. Primarily, the Ordinance requires the Assistant Minister for Regional Development and Territories to assess whether an emergency exists that endangers or threatens to endanger the safety or health of persons in the Jervis Bay Territory to a significant and widespread extent. Once satisfied, the Assistant Minister must revoke any previous declarations of a state of emergency and make a new declaration as stipulated in the Ordinance. This ensures that the emergency management measures in place are current and directly address the current situation.
Breaching the provisions of the Jervis Bay Territory Emergency Management Ordinance 2015 can lead to various consequences. Although the specific offences, penalties, or consequences for breach are not detailed in the text, the Ordinance likely includes provisions that could lead to civil or criminal penalties for non-compliance. Given the context of emergency management, breaches could potentially result in significant penalties, reflecting the seriousness of ensuring public safety and health during an emergency. The maximum penalties, if stated, would depend on the nature and severity of the breach, but they are likely to be severe given the critical nature of emergency management.
