Overview

The Declaration of State of Emergency (Jervis Bay Territory) (No. 1) 2021 was enacted by the Jervis Bay Territory Emergency Management Ordinance 2015, introduced to address situations that endanger or threaten the safety or health of individuals in the Jervis Bay Territory. This ordinance was enacted by the Australian Government, specifically through the Assistant Minister for Regional Development and Territories, who has the authority to declare a state of emergency under subsection 15(1) of the Ordinance. The primary policy objective of this legislation is to provide a legal framework for the declaration of a state of emergency in the Jervis Bay Territory, allowing for appropriate measures to be taken to mitigate the risks and protect public safety and health. This declaration revokes all previous emergency declarations and establishes a state of emergency for a period of 30 days, beginning from the date of the instrument's issuance.

Scope and Application

The Declaration of State of Emergency (Jervis Bay Territory) (No. 1) 2021 pertains to the Jervis Bay Territory and is issued under the Jervis Bay Territory Emergency Management Ordinance 2015. This legislative instrument applies to all persons and entities within the Jervis Bay Territory and is intended to address emergencies that significantly and extensively threaten the safety or health of individuals in the area. The scope of the Act encompasses the whole territory, and its primary purpose is to facilitate effective emergency management by allowing for the declaration and subsequent management of a state of emergency. The declaration revokes all previous emergency declarations under the same subsection of the Ordinance, thereby establishing a singular, comprehensive response framework for the current emergency situation. The jurisdictional reach of this Act is limited to the Jervis Bay Territory, and it operates within the parameters set by the Jervis Bay Territory Emergency Management Ordinance 2015. The Act extends its application through subordinate instruments, which may provide further details and operational guidelines for managing the declared state of emergency.

Key Provisions

The Declaration of State of Emergency (Jervis Bay Territory) (No. 1) 2021 revokes all previous declarations made under subsection 15(1) of the Jervis Bay Territory Emergency Management Ordinance 2015 and establishes a new state of emergency throughout the Jervis Bay Territory, effective for a period of 30 days from the date of issuance. This declaration is rooted in the recognition that an emergency is either already endangering or threatening to endanger the safety or health of individuals within the territory on a significant and widespread scale. Under this legislation, the Jervis Bay Territory Emergency Management Ordinance 2015 grants specific powers and authorities to manage the emergency situation. The declaration allows for the implementation of extraordinary measures and provisions to address the emergency, ensuring the protection and well-being of the territory's residents and visitors. These measures can include restrictions on movement, the allocation of resources, and the enforcement of health and safety protocols. Entities and individuals governed by this Act are obligated to comply with the emergency measures and directives issued by the Assistant Minister for Regional Development and Territories. This includes adhering to any curfews, movement restrictions, or other safety protocols that may be implemented to mitigate the emergency's impact. Failure to comply with these directives could result in legal repercussions, including fines, imprisonment, or other penalties as stipulated in the relevant sections of the Ordinance. The legislation also outlines specific offences and penalties for non-compliance with the emergency measures. For instance, subsection 15(4) of the Ordinance provides for the imposition of fines up to $10,000 for individuals and $50,000 for bodies corporate found guilty of breaching the emergency regulations. Additionally, criminal charges may be brought against those who willfully disregard the directives, leading to more severe penalties, including imprisonment for up to two years. These consequences are intended to ensure strict adherence to the emergency measures and to protect public safety during this critical period.
