Overview

The Commonwealth of Australia Remuneration Tribunal Act 1973 was enacted to address the need for a framework to determine the remuneration of holders of key public service positions, including the Governor and Deputy Governor of the Reserve Bank of Australia. This Act provides the legislative basis for the Remuneration Tribunal, which is tasked with setting appropriate levels of remuneration for principal executive officers in the public sector. The policy objective of this Act is to ensure that the remuneration of these high-ranking public officers is fair, competitive, and reflective of their responsibilities and the prevailing market conditions. The enacting body for this Act is the Parliament of the Commonwealth of Australia, which passed the legislation to provide clarity and consistency in the remuneration of public office holders. The declaration made by Patrick Gorman, the Assistant Minister for the Public Service, under sections 3B of the Remuneration Tribunal Act 1973 and 33(3) of the Acts Interpretation Act 1901, specifically updates the employing bodies for the Governor and Deputy Governor positions at the Reserve Bank of Australia, effective from 1 March 2025.

Scope and Application

The Remuneration Tribunal Act 1973, as amended by the Gazetted declaration of the Assistant Minister for the Public Service, specifies the employing bodies for the Principal Executive Offices of the Reserve Bank of Australia. This declaration applies to the Governor and Deputy Governor of the Reserve Bank of Australia, with the Governance Board of the Reserve Bank of Australia designated as their employing body. This legislative action is grounded in the Commonwealth of Australia and carries the full legal weight of the federal jurisdiction. The declaration revokes all previous declarations concerning these offices and takes effect from 1 March 2025. It is important to note that the Act and its amendments do not specify any exclusions or exemptions, thereby encompassing all relevant offices and authorities within its scope. The application of the Act is further extended or restricted by subordinate instruments, which may provide additional detail or clarification on the implementation and enforcement of the Act's provisions.

Key Provisions

The declaration issued under section 3B of the Remuneration Tribunal Act 1973 (the "Act") identifies and establishes new employing bodies for specific principal executive offices within the Reserve Bank of Australia, effective from 1 March 2025. This includes the Governor and the Deputy Governor of the Reserve Bank of Australia, with the Governance Board of the Reserve Bank of Australia designated as the employing body for both positions (s. 3B(2)). This section also revokes all prior declarations concerning these offices, ensuring that the new designations are the sole applicable definitions as of the specified effective date. Under this Act, the obligations of the newly declared employing bodies, namely the Governance Board of the Reserve Bank of Australia, include the responsibility to determine and manage the remuneration of the Governor and Deputy Governor. This encompasses not only the base salary but also any allowances, benefits, and other forms of compensation that fall under the purview of the Act (s. 12). The Governance Board must ensure that these remunerations comply with the principles and guidelines set forth by the Remuneration Tribunal, which aims to align executive compensation with public sector standards and the broader economic context. Failure to adhere to the requirements and obligations outlined in the Act may result in legal consequences. While specific offences and penalties are not detailed in the declaration itself, breaches of the Act could potentially lead to actions under the general provisions of the Act, which might include civil penalties for non-compliance or other legal remedies. The maximum penalties for offences under the Act can vary but may include substantial fines and, in serious cases, potential criminal charges. The precise consequences would depend on the nature and severity of the breach, as well as the provisions of other related legislation.
