Overview
The Remuneration Tribunal Act 1973 was enacted to address the need for a structured and transparent process for determining the remuneration of public service officers in Australia, including the principal executive officers of various government entities. This Act was passed by the Commonwealth Parliament to ensure that the remuneration of these officers is fair and competitive, while also being commensurate with their responsibilities and the overall public service framework. The policy objective of the Act is to maintain a professional and efficient public service by appropriately compensating its leaders, thereby attracting and retaining high-quality talent. The 2017 declaration under the Act, signed by Michaelia Cash, Minister Assisting the Prime Minister for the Public Service, exemplifies the application of the Act by formally assigning the employing body for the principal executive office of the Managing Director of the Australian Postal Corporation and classifying this position within the remuneration structure determined by the Remuneration Tribunal. This specific declaration aims to bring clarity to the remuneration arrangements for the Managing Director of the Australian Postal Corporation, ensuring alignment with the broader objectives of the Act.
Scope and Application
The Remuneration Tribunal Act 1973, as declared by the Minister Assisting the Prime Minister for the Public Service, designates specific roles and responsibilities within the Australian Postal Corporation. This declaration applies to the Board of the Australian Postal Corporation, which is recognised as the employing body for the principal executive office of the Managing Director. Additionally, the declaration assigns the principal executive office of the Managing Director to classification E within the classification structure determined by the Remuneration Tribunal. The scope of this declaration is national, applying across the Commonwealth of Australia and affecting entities and positions governed under the Act. The declaration does not specify exclusions or exemptions but rather establishes a framework for the remuneration of the specified executive office within the organisation. The application of this Act can be further extended or modified through subordinate instruments issued by the Remuneration Tribunal in accordance with the provisions of the Act.
Key Provisions
The main operative sections of this declaration under the Remuneration Tribunal Act 1973 pertain to the identification and classification of the principal executive office of the Managing Director of the Australian Postal Corporation. Section 3B declares that the Board of the Australian Postal Corporation is the employing body for this position (s.3B). Additionally, section 3A(2) designates this principal executive office to classification E within the classification structure determined by the Remuneration Tribunal (s.3A(2)). This classification is in accordance with the structure established under section 5(2A) of the Act (s.5(2A)). These declarations establish the administrative and structural framework for the remuneration of the Managing Director.
The obligations and requirements imposed by the Act on the parties and entities it governs are primarily centred around the formal identification of the employing body and the classification of the principal executive office. The Board of the Australian Postal Corporation, as the employing body, is responsible for ensuring that the remuneration of the Managing Director aligns with the classification determined by the Remuneration Tribunal. The declaration mandates that the Managing Director's office is to be classified as E, thereby ensuring that the remuneration and associated benefits are in accordance with this classification. This structured approach facilitates transparency and consistency in the determination of executive remuneration within public sector entities.
Under the Act, any breach of the obligations or requirements could lead to civil or administrative consequences. Although the specific penalties are not detailed within this declaration, breaches of provisions under the Remuneration Tribunal Act 1973 may typically result in enforcement actions, fines, or other corrective measures to ensure compliance with the designated classifications and employing body requirements. The Act's framework is designed to maintain accountability and adherence to the stipulated remuneration structures, ensuring that executive positions are appropriately classified and compensated.
