Overview

The Commonwealth of Australia Remuneration Tribunal Act 1973 was enacted to establish the Remuneration Tribunal, which is responsible for determining the remuneration of the holders of certain offices and positions within the public service. The Act aims to ensure that the remuneration of public service executives is set in a fair and transparent manner, reflecting their responsibilities and the need to attract and retain high-quality talent. This particular declaration, issued by Mark Dreyfus, Minister for the Public Service and Integrity, under sections 3A(2) of the Remuneration Tribunal Act 1973 and 33(3) of the Acts Interpretation Act 1901, revokes previous declarations concerning the classification band for the principal executive office of the Chief Executive Officer of the Indigenous Land Corporation and assigns it to classification band C, effective from 30 May 2013. This action is taken to align with the policy objective of the Act to ensure appropriate remuneration structures for public service executives.

Scope and Application

The Remuneration Tribunal Act 1973 applies to the establishment and classification of the principal executive offices within the Commonwealth of Australia, governing the remuneration of individuals in these roles. Specifically, this Act empowers the Remuneration Tribunal to determine the classification bands for principal executive offices, thereby setting the remuneration framework for these positions. In the context of the declaration concerning the Chief Executive Officer of the Indigenous Land Corporation, the Act applies to the specific office and the individual occupying it. The Act's jurisdictional reach is national, applying across the Commonwealth of Australia, and it is administered by the Remuneration Tribunal, a body established under the Act. The declaration made by the Minister for the Public Service and Integrity revokes any previous classifications for this particular office and assigns it to classification band C, effective from 30 May 2013. The Act may extend its application through subordinate instruments, which would further define and detail the specific classifications and remuneration for various principal executive offices.

Key Provisions

The key operative sections of this declaration, under the Remuneration Tribunal Act 1973, include the revocation of all previous declarations concerning the classification band for the principal executive office of the Chief Executive Officer at the Indigenous Land Corporation (subsection 3A(2)). It further includes the assignment of this office to classification band C within the principal executive office structure, as determined by the Remuneration Tribunal under section 5(2A). This declaration is effective from 30 May 2013, as stated in the document. The obligations and requirements imposed by this Act primarily concern the classification and remuneration of the Chief Executive Officer's position within the Indigenous Land Corporation. The Minister for the Public Service and Integrity is responsible for making such declarations under section 3A(2) of the Act, ensuring that the position is correctly classified within the prescribed band. The Remuneration Tribunal's determination under section 5(2A) plays a crucial role in establishing the principal executive office structure, which guides the classification of various executive roles across the public sector. There are no explicit offences or penalties mentioned in this particular declaration. However, the broader Remuneration Tribunal Act 1973 and related legislation may include provisions for penalties or other consequences in the event of non-compliance with the Act's requirements. The declaration itself serves as an administrative action to align the classification of the Chief Executive Officer's position with the established framework, ensuring that remuneration and other employment conditions are set according to the correct classification band.
