DECLARATION OF CORRESPONDING STATE LAW UNDER SECTION 12

 

 

I, Catherine King, Parliamentary Secretary to the Minister for Health, declare that the following state laws to correspond to the Gene Technology Act 2000 (Cth) and the Gene Technology Regulations 2001 (Cth):

Overview

The Gene Technology Act 2000 was enacted by the Parliament of Australia to establish a regulatory framework governing the use, handling, storage, and movement of genetically modified organisms (GMOs) and products containing genetic material in Australia. This legislation was introduced to address the need for a unified and comprehensive regulatory approach to gene technology, ensuring the protection of human health and the environment while facilitating innovation and economic growth. The policy objective of the Act is to regulate the use of gene technology in a manner that balances the potential benefits of genetic modification with public safety and environmental concerns. The declaration made by Catherine King, Parliamentary Secretary to the Minister for Health, on 28 November 2012, indicates that the Gene Technology (Tasmania) Act 2012 corresponds to the federal Gene Technology Act 2000 and the Gene Technology Regulations 2001. This declaration signifies Tasmania's commitment to aligning its state-level legislation with the overarching national framework, ensuring consistent regulation and enforcement of gene technology across Australia.

Scope and Application

The Gene Technology Act 2000 (Cth), complemented by the Gene Technology Regulations 2001 (Cth), regulates the handling, storage, use, and release of genetically modified organisms (GMOs) and products containing them, in addition to any dealings with genetically modified material. This Act applies to individuals, companies, and entities that engage in activities involving GMOs and their products, as well as those that intend to conduct such activities, within Australia and its territories. The Act provides a comprehensive framework that governs the conduct and transactions related to GMOs, ensuring that they are managed responsibly and safely. The application of the Act is further extended to corresponding state laws, such as the Gene Technology (Tasmania) Act 2012, which is declared to correspond to the federal legislation, thereby ensuring uniformity across jurisdictions. Any exemptions, exclusions, or thresholds are specified within the Act and the Regulations, while the scope of the Act can be expanded or restricted through subordinate instruments, allowing for flexibility in its application to various sectors and activities.

Key Provisions

The main operative sections of the Gene Technology Act 2000 (Cth) establish the legal framework for regulating activities involving gene technology in Australia. Section 4 outlines the Act's purpose, which is to protect the health and safety of people and the environment, and to ensure the responsible use of gene technology. Section 6 defines key terms such as "gene technology" and "genetically modified organisms" (GMOs). Section 21 requires a licence for certain activities involving GMOs, such as their release into the environment or commercial use. Section 24 sets out the process for granting or refusing a licence, including public consultation and risk assessment. Section 36 details the offences and penalties for non-compliance with the Act, including fines and imprisonment. The obligations and requirements imposed by the Act on parties or entities it governs are comprehensive. Firstly, entities must obtain a licence before engaging in activities involving GMOs, such as research, production, and commercial use (Section 21). This includes submitting detailed applications, including risk assessments and management plans, to the Office of the Gene Technology Regulator (Section 25). Public notification and consultation processes are mandatory, ensuring that the community is informed and can provide feedback (Section 26). Entities must also comply with the terms and conditions of their licence, including ongoing monitoring and reporting requirements (Section 27). Additionally, the Act imposes specific obligations on researchers and institutions, such as maintaining records and ensuring the secure handling of GMOs (Section 30). Failure to comply with the Gene Technology Act 2000 (Cth) can result in serious civil and criminal consequences. Section 36 outlines the offences and penalties for non-compliance, which include fines and imprisonment. For example, knowingly releasing GMOs into the environment without a licence is an offence punishable by a fine of up to $1.1 million or imprisonment for up to five years, or both (Section 36(1)). Similarly, contravening licence conditions can result in fines of up to $1.1 million and imprisonment for up to one year (Section 36(2)). The Act also provides for the recovery of costs incurred by the Regulator in enforcing the Act (Section 37). Furthermore, individuals and organisations found guilty of serious breaches can face additional penalties, such as the cancellation of their licence and exclusion from future applications (Section 38). These stringent measures are in place to ensure strict adherence to the regulatory framework and to protect public health and the environment.
