Overview

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) was enacted by the Australian Parliament to provide for the protection of the environment, particularly with respect to matters of national environmental significance. The Act aims to promote the ecologically sustainable use of natural resources and to protect and conserve Australia's biodiversity. This legislation addresses the gap in existing laws by providing a comprehensive framework for the protection of the environment, including wildlife trade, and ensuring that significant actions that may impact the environment are assessed and managed appropriately. In August 2018, a declaration was issued under the EPBC Act, declaring the operations for the harvesting of fish specimens taken in the Western Australian West Coast Demersal Gillnet and Demersal Longline [Interim] Managed Fishery, and the Joint Authority Southern Demersal Gillnet and Demersal Longline Managed Fishery as an approved wildlife trade operation, subject to certain conditions. The declaration was made by the Assistant Secretary, Wildlife Trade and Biosecurity Branch, as the Delegate of the Minister for the Environment and Energy, and is valid until 20 August 2021, unless amended or revoked. The policy objective of the EPBC Act is to protect and conserve Australia's biodiversity and ecosystems, while also promoting the ecologically sustainable use of natural resources. The declaration of the approved wildlife trade operation aims to ensure that the harvesting of fish specimens from the specified fisheries is conducted in a manner that is ecologically sustainable and does not negatively impact listed threatened species or taxa listed under Australia's CITES list, with the exception of Scalloped Hammerhead Shark (Sphyrna lewini) and Smooth Hammerhead Shark (S. zygaena). The declaration also requires the Western Australian Department of Primary Industries and Regional Development to implement certain conditions, such as reporting on management changes, producing annual reports, and developing a formal Harvest Strategy by early 2020, to ensure the ongoing sustainability of the fisheries.

Scope and Application

The Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act) applies to the operations involved in the Western Australian West Coast Demersal Gillnet and Demersal Longline [Interim] Managed Fishery, and the Joint Authority Southern Demersal Gillnet and Demersal Longline Managed Fishery. This application specifically concerns the harvesting of fish or invertebrate specimens derived from these fisheries, excluding those belonging to eligible listed threatened species or taxa listed under Australia’s CITES list, except for Scalloped Hammerhead Shark (Sphyrna lewini) and Smooth Hammerhead Shark (S. zygaena). The declaration, made by the Assistant Secretary of the Wildlife Trade and Biosecurity Branch under the authority of the Minister for the Environment and Energy, is valid until 20 August 2021, subject to the conditions specified in the Schedule of the EPBC Act. These conditions include the requirement for the Western Australian Department of Primary Industries and Regional Development to report any significant changes in management arrangements, provide annual reports on the fisheries' ecological sustainability, assess the recovery status of breeding stocks, develop a formal Harvest Strategy, update the Environmental Significance Documentation (ESD) report, and work towards the implementation of electronic logbooks and additional education for fishers. This declaration is part of the broader legislative framework that aims to ensure the sustainable management of fisheries while protecting biodiversity.

Key Provisions

The main operative sections of this declaration (section 303FN(2) and paragraph 303FN(10)(d) of the Environment Protection and Biodiversity Conservation Act 1999) declare the operations for the harvesting of fish specimens, or specimens derived from fish or invertebrates, taken in the Western Australian West Coast Demersal Gillnet and Demersal Longline [Interim] Managed Fishery, and the Joint Authority Southern Demersal Gillnet and Demersal Longline Managed Fishery as an approved wildlife trade operation. This declaration excludes specimens of eligible listed threatened species and taxa listed under Australia's CITES list, except for Scalloped Hammerhead Shark (Sphyrna lewini) and Smooth Hammerhead Shark (S. zygaena). The declaration is valid until 20 August 2021 and is subject to conditions specified in the Schedule. The obligations imposed by this declaration include adherence to the Western Australian Fish Resources Management Act 1994 and the Western Australian Fish Resources Management Regulations 1995 for the operation of the Western Australian Temperate Demersal Gillnet and Demersal Longline Fisheries. The Western Australian Department of Primary Industries and Regional Development must inform the Department of the Environment and Energy of any material changes to the management arrangements that may impact the assessment against which Environment Protection and Biodiversity Conservation Act 1999 decisions are made. Additionally, the Department must produce annual reports as per Appendix B of the Guidelines for the Ecologically Sustainable Management of Fisheries - 2nd Edition. The Department must also continue to assess the recovery status of breeding stocks, develop a formal Harvest Strategy, review and update the Environmentally Sustainable Development (ESD) report, and work towards the implementation of electronic logbooks in the fisheries. Failure to comply with the obligations and conditions set out in this declaration may result in civil or criminal consequences. However, the specific offences, penalties, or consequences for breach are not explicitly stated in the declaration itself. Individuals or entities affected by this declaration have the right to seek reasons for the decision from the Department of the Environment and Energy within 28 days. An application for independent review of the decision can be made to the Administrative Appeals Tribunal within 28 days of receipt of the reasons for the decision or within 28 days of this declaration if reasons for the decision are not sought. Applications should be made to the Deputy Registrar, AAT in your Capital City. Further enquiries can be directed to the Director, Wildlife Trade Assessments Section, Department of the Environment and Energy.
