DAIRY PRODUCTS (EXPORT INSPECTION CHARGE) COLLECTION ACT 1982

DAIRY PRODUCTS (EXPORT INSPECTION CHARGE) COLLECTION REGULATIONS (AMENDMENT)

The Dairy Products (Export Inspection Charge) Collection Act 1982 provides for the Governor-General to make regulations for the purpose of the collection of the charge imposed by the Dairy Products (Export Inspection Charge) Act 1982. The first Act provides that the regulations may prescribe the manner of payment of charge and other moneys payable to the Commonwealth under the Act.

In sub-section 3(1) of the Act, “prescribed export permit”, in relation to dairy products, is defined to mean “a licence, permit or other permission issued in relation to the export of those dairy products that is declared by the regulations to be a prescribed export permit”.

Regulation 4 of the Dairy Products (Export Inspection Charge) Collection Regulations declares an export permit in


force under regulation 22 of the Export Control (General) Regulations to be a prescribed export permit.

With effect on 29 April 1985 the Export Control (General) Regulations were amended so that they no longer apply to dairy products for the purposes of the Export Control Act 1982. On that day orders made under regulation 3 of the Export Control (Orders) Regulations came into effect that apply to dairy products for the purposes of the Export Control Act 1982. As a result the Dairy Products (Export Inspection Charge) Collection Regulations were amended to substitute a reference to such orders for the reference to regulation 22 of the Export Control (General) Regulations.
