Overview

The Dairy Produce Export Control Regulations 1953 were enacted to provide detailed administrative and operational frameworks for the enforcement of the Dairy Produce Export Control Act 1924-1947. The Act was initially introduced to regulate and control the export of dairy products from Australia, ensuring that exports met certain quality and quantity standards. The problem the Act sought to address was the need for effective oversight and regulation of dairy exports to maintain standards and manage supply chains effectively. The 1953 Regulations were introduced to further clarify and implement the provisions of the Act by the Governor-General in Council, providing specific guidelines for the salaries, conditions of employment, and operational protocols for officers appointed under the Act. The enacting body was the Australian Federal Parliament, with the policy objective of ensuring the efficient and effective administration of dairy export controls.

Scope and Application

The regulations under the Dairy Produce Export Control Act 1924-1947 primarily apply to officers appointed under the Act and their employment conditions. These officers are integral to the administration and enforcement of dairy export controls and regulations. The Act's application extends across the Commonwealth of Australia, thereby encompassing all federal jurisdictions. The regulations detail salary structures, conditions of employment, and other relevant terms for these officers, ensuring consistency with the broader Commonwealth Public Service standards. Notably, the regulations also include provisions for officers employed in the United Kingdom, aligning their employment conditions with the High Commissioner (Staff) Regulations. Specific exclusions and exemptions are not explicitly mentioned in the provided text, but the regulations do address certain transitional periods for salary determinations, ensuring that officers are compensated accurately for their service during defined periods. The Act and its regulations provide a comprehensive framework for managing the staff involved in dairy export controls, ensuring both operational efficiency and fair employment practices.

Key Provisions

The main operative sections of these Regulations detail the salaries and conditions of employment for officers appointed under the Dairy Produce Export Control Act 1924-1947. Regulation 3 provides definitions for key terms such as "officer," "Act," and "Secretary," ensuring clarity in the application of the Regulations. Regulation 5 outlines the salaries for various officer positions, specifying the annual salary limits and increments for each role, as detailed in the accompanying tables. Regulation 5b stipulates that officers will be employed under conditions similar to those of Commonwealth Public Service officers, with adjustments made for specific roles as per relevant arbitration determinations. These Regulations impose specific obligations and requirements on officers appointed under the Act. Officers must adhere to the salary structures outlined in Regulation 5 and cannot receive salary increments until they have served for at least twelve months without increment (Regulation 5(2)). Furthermore, officers are governed by the same employment conditions as Commonwealth Public Service officers, including leave, holidays, and overtime, as detailed in Regulation 5b. These conditions may be adjusted to align with arbitration determinations where applicable. Breach of these Regulations may not explicitly outline specific offences or penalties within the provided text. However, non-compliance with the stipulated salary and employment conditions could potentially lead to disciplinary actions under the broader framework of the Public Service Act and Regulations, which may include penalties such as fines or other administrative sanctions. The exact nature and extent of penalties would depend on the specific breaches and the applicable laws governing public service employment.
