Overview

The Statutory Rules of 1957, No. 50, under the Dairy Produce Export Control Act 1924-1954, were enacted to amend existing regulations regarding the export of dairy produce, specifically focusing on licensing requirements and the scope of products covered by these regulations. These regulations were made by the Governor-General in Council, acting on the advice of the Federal Executive Council. The primary objective of these amendments was to tighten control over the export of dairy products, including casein, and to ensure that only licensed entities could export such products, thereby regulating the flow of these goods and maintaining quality and compliance standards in international trade. This legislative instrument aimed to address potential gaps in the oversight of dairy exports, ensuring that exports were managed in a way that supported both domestic and international market interests.

Scope and Application

The Dairy Produce Export Control (Licences) Regulations 1957, issued under the Dairy Produce Export Control Act 1924-1954, govern the export of dairy produce, including butter, cheese, and casein, from Australia. The Act applies to any person or entity involved in the export of these products, and it mandates that such exports are only lawful if a valid licence has been obtained in accordance with the regulations. The scope of these regulations extends to prohibiting the export of dairy produce to the United Kingdom and other countries unless the exporter holds the requisite licence. The regulations also provide for specific conditions and restrictions on the export of dairy products intended for use as ship's stores by overseas-bound vessels, requiring either a licence or written authorisation from the Australian Dairy Produce Board. The application of these regulations is nationwide, applying uniformly across the Commonwealth of Australia, with the Minister of State for Primary Industry, or an authorised person, issuing export licences as stipulated. The regulations do not specify exclusions or exemptions but lay out a clear licensing framework that must be adhered to for lawful exports of dairy produce.

Key Provisions

The Dairy Produce Export Control (Licences) Regulations, as amended by Statutory Rules 1957, No. 50, establish a framework for the export of dairy produce and casein, as defined by the Dairy Produce Export Control Act 1924-1954. The primary focus of these Regulations is to regulate the export of dairy products, such as butter and cheese, and casein, by requiring the issuance of specific export licenses. Regulation 4a explicitly states that casein is now included in the definition of 'dairy produce', which was previously limited to butter and cheese. Regulation 5 further outlines the prohibition of the export of these products to various destinations unless a relevant export license is held. This prohibition applies to exports to the United Kingdom, other countries, and as ship's stores, and specifically to casein. These Regulations impose several obligations on the parties involved. Firstly, they require that any person or entity intending to export dairy produce or casein must obtain a valid export license as specified in the Regulations (Regulation 5). The process for obtaining these licenses is detailed in Regulation 6, which mandates that licenses are granted by the Minister of State for Primary Industry or an authorized person, upon the recommendation of the Australian Dairy Produce Board. The Regulations also set out the conditions and restrictions that must be adhered to by the licensees, as detailed in the various sub-regulations of Regulation 5. Failure to comply with the provisions of these Regulations can result in significant consequences. The export of dairy produce or casein without the required license is strictly prohibited (Regulation 5). Any person found to be in breach of these prohibitions may face legal penalties. While the specific penalties are not detailed within the text of these Regulations, breaches of similar provisions under the parent Act or related legislation typically result in fines and potential imprisonment. The exact penalties would depend on the severity and intent of the breach, as well as any relevant case law or subsequent legislative amendments.
