Overview

The Dairy Industry Stabilization Levy Regulations 1978 were enacted under the authority of the Dairy Industry Stabilization Levy Act 1977 to address the need for a regulatory framework that governs the stabilisation of the Australian dairy industry. These regulations were introduced by the Parliament of Australia, with the policy objective of providing a stable and sustainable environment for the dairy industry. The enactment of these regulations was in response to the recommendations made by the Australian Dairy Corporation in consultation with the Australian Dairy Industry Advisory Committee, as mandated by the Act. The regulations detail specific rates of levy for various dairy products and the prescribed dates and periods relevant to these levies, ensuring that the financial mechanisms within the dairy industry are effectively managed and compliant with the legislative framework.

Scope and Application

The Dairy Industry Stabilization Levy Regulations 1978 apply to dairy products as defined by the Dairy Industry Stabilization Levy Act 1977, which includes the manufacture, processing, and sale of these products within Australia. The regulations are applicable to entities and individuals engaged in the dairy industry, such as dairy farmers, processors, and retailers, ensuring compliance with the specified rates of levy for various dairy products. The geographic reach of these regulations is national, as they are enacted under Commonwealth law. The regulations are designed to provide a structured and consistent framework for levy collection and compliance across all states and territories. While the Act primarily governs the dairy industry, certain exclusions or exemptions may apply as specified in the detailed regulations. The scope of the Act can be extended or restricted through subordinate instruments, allowing for adjustments based on recommendations from the Australian Dairy Corporation and the Australian Dairy Industry Advisory Committee, ensuring the framework remains relevant and effective.

Key Provisions

The main operative sections of these Regulations include the amendment of the definition of "modified skimmilk powder" (section 2), the setting of a prescribed date for whole milk powder (section 3), the repeal of Regulation 8 and its substitution with a new regulation specifying a prescribed period for certain dairy products (section 4), and the amendment of Schedule 2 to set new rates of levy for various dairy products (section 5). These changes aim to clarify the definition of certain dairy products, set specific dates and periods for levy application, and adjust the rates at which levies are charged. The Regulations impose obligations on parties involved in the dairy industry to comply with the new definitions and rates specified. For example, manufacturers and processors of dairy products must ensure that their products meet the revised definitions, particularly for modified skimmilk powder. They must also be aware of the new prescribed dates and periods that apply to the levy, such as the commencement date of 1 July 1978 for whole milk powder and the prescribed period for certain dairy products starting from the same date. Furthermore, these parties must adjust their calculations to reflect the new rates of levy as detailed in Schedule 2, ensuring accurate reporting and payment of levies. Failure to comply with these Regulations can lead to various consequences. While the specific offences and penalties are not detailed within the text of these Regulations, under the broader framework of the Dairy Industry Stabilization Levy Act 1977, breaches could result in civil or criminal penalties. These may include fines and other enforcement actions as prescribed by the Act. The maximum penalties would depend on the nature and severity of the breach, as well as any additional provisions or amendments made to the Act or subsequent regulations.
