Overview
The Customs Tariff Validation Act 1978 was enacted to address the need for legal validation of certain collections of duties of Customs that had been carried out under specific Customs Tariff Proposals prior to its enactment. The Act was enacted by the Queen, in accordance with the authority of the Parliament of the Commonwealth of Australia, to ensure that duties collected in reliance on these proposals would be recognised as lawful. The policy objective behind this legislation was to provide certainty and legitimacy to the collections made before the Act came into force, thereby preventing any legal challenges to the validity of those collections. This Act aimed to validate the duties of Customs that were collected pursuant to Customs Tariff Proposals introduced into the House of Representatives on 24 May 1978, up until 31 December 1978.
Scope and Application
The Customs Tariff Validation Act 1978 applies to duties of Customs that were demanded or collected on or before 31 December 1978 in accordance with Customs Tariff Proposals introduced into the House of Representatives on 24 May 1978. These duties, whether collected before or after the Act's commencement, are deemed to have been lawfully imposed and collected. The Act has a national reach, extending across the Commonwealth of Australia, and it aims to validate specific past collections of customs duties. There are no exclusions, exemptions, or thresholds specified within the Act itself, and the validation applies to all duties collected under the mentioned Customs Tariff Proposals. The Act's application may be further refined or extended through subordinate instruments, though the primary text itself does not provide details on such extensions.
Key Provisions
The Customs Tariff Validation Act 1978 (sections 1-3) provides for the legal validation of certain collections of duties of Customs. The Act ensures that duties collected up until 31 December 1978, in accordance with Customs Tariff Proposals introduced into the House of Representatives on 24 May 1978, are deemed to have been lawfully imposed and collected. This Act comes into effect on the day it receives the Royal Assent.
The Act imposes specific obligations on entities involved in the collection of duties of Customs. It validates the duties that were collected prior to and on the date of the Act’s commencement, ensuring that these collections were in line with the Customs Tariff Proposals. The primary requirement is that the collections were made in accordance with the proposals introduced into the House of Representatives on 24 May 1978, and they must have occurred no later than 31 December 1978.
The Act does not explicitly outline any offences or penalties for breach within its provisions. However, by validating the collections of duties, it implicitly ensures compliance with the legal requirements for those collections. Although the Act does not provide for specific maximum penalties, any non-compliance or disputes regarding the validity of collections prior to this Act’s operation could potentially be addressed under other relevant legislation or common law principles. The validation provided by this Act serves to protect both the government and taxpayers from any retrospective legal challenges regarding the validity of these specific duty collections.
