Overview
The Customs Tariff (New Zealand Preference) 1960 was enacted to amend the existing Customs Tariff (New Zealand Preference) 1933-1959, introducing specific changes to the tariff rates on goods originating from or manufactured in New Zealand. This Act was assented to on 26 May 1960 by the Queen’s Most Excellent Majesty, the Senate, and the House of Representatives of the Commonwealth of Australia. The primary purpose of this legislation was to adjust the tariff rates on certain goods, such as textile piece goods of wool or containing wool, and to impose new duties on date, sealing, and similar stamps not incorporating clock movements. These amendments aimed to refine the preferential treatment of New Zealand goods within the Australian customs framework, ensuring alignment with evolving trade relations and economic considerations between the two countries.
Scope and Application
The Customs Tariff (New Zealand Preference) 1960 Act, which amends the Customs Tariff (New Zealand Preference) 1933-1959, applies to goods produced or manufactured in New Zealand that are imported into Australia. The primary purpose of this Act is to modify the tariff rates for specific goods originating from New Zealand, thereby imposing duties on these imports. The Act imposes ad valorem duties on certain textile piece goods of wool or containing wool and on date, sealing, and similar stamps not incorporating clock movements. The Act’s jurisdiction is within the Commonwealth of Australia, affecting importers, exporters, and businesses involved in the import of specified goods from New Zealand. The amendments come into effect on the twenty-ninth day of April, 1960, as stipulated in the Act. The application of this legislation is further refined through subordinate instruments, which may include regulations and orders detailing specific implementation and enforcement aspects.
Key Provisions
The Customs Tariff (New Zealand Preference) 1960 (C1960A00024) amends the existing Customs Tariff (New Zealand Preference) 1933-1959 to update tariff rates on certain goods originating from New Zealand. Section 2 of the Act specifies the amendments to the tariff schedule, primarily affecting textile piece goods of wool or containing wool and introducing a new tariff on date, sealing, and similar stamps. These changes are detailed in the Schedule to the Act, which provides the specific modifications to the tariff rates.
The obligations imposed by the Act on parties and entities include compliance with the new tariff rates specified in the amended Schedule. Importers and exporters of the affected goods must now adhere to the updated rates, ensuring that their declarations and payments to Customs reflect these changes. This requirement ensures that the correct duties are levied and collected on the specified goods, maintaining the integrity of the tariff system.
Breaching the provisions of this Act can lead to various civil and criminal consequences. Specifically, Section 3 of the Act outlines the time of imposition of the duties, which is the twenty-ninth day of April 1960, at nine o'clock in the forenoon. Non-compliance with the amended tariff rates could result in penalties, which may include fines or other financial penalties as stipulated by the Customs Act. The precise penalties would depend on the nature and severity of the breach, but they are intended to enforce adherence to the new tariff regulations.
