Overview

The Customs Tariff Amendment (Product Stewardship for Waste Oil) Act 2000 was enacted by the Parliament of Australia to address the need for better management and regulation of waste oil within Australia. This Act serves to amend the Customs Tariff Act 1995 to ensure that waste oil is properly managed through the imposition of duties and charges on the importation of petroleum-based oils and other related goods. The primary objective of this legislation is to facilitate the implementation of a product stewardship scheme for waste oil, ensuring that importers contribute to the responsible handling and recycling of waste oil. The Act came into force following the Royal Assent on 6 July 2000, with certain provisions contingent on the commencement of the Product Stewardship (Oil) Act 2000.

Scope and Application

The Customs Tariff Amendment (Product Stewardship for Waste Oil) Act 2000 is a piece of Australian legislation that seeks to amend the Customs Tariff Act 1995, specifically to address the management and regulation of waste oil through product stewardship. This Act applies to the importation of goods into Australia and pertains to certain petroleum-based oils and greases, as well as preparations for the treatment of textile materials, leather, furskins, or other materials. The amendments introduced by this Act adjust the rates of duty and specific tariffs for these goods, thereby influencing the economic and regulatory environment for their importation. The scope of the Act is national, as it pertains to the Customs Tariff Act 1995, which is a Commonwealth statute. The Act commenced on the Royal Assent date, but Schedule 1, which contains the amendments to the Customs Tariff Act 1995, commenced on the same day as section 9 of the Product Stewardship (Oil) Act 2000. The Act does not explicitly mention exclusions or exemptions, and while it provides for the possibility of further adjustments through subordinate instruments such as Tariff Concession Orders, the primary changes are outlined in the Schedule to this Act.

Key Provisions

The Customs Tariff Amendment (Product Stewardship for Waste Oil) Act 2000 (Cth) amends the Customs Tariff Act 1995 (Cth) to introduce specific duties on various oil products, including petroleum-based oils and greases, as well as on preparations for the treatment of textile materials, leather, furskins or other materials. The Act also introduces new rates of duty for goods classified under heading 3819.00.00 of Schedule 3 of the Customs Tariff Act 1995 (Cth) (sections 1-9). The Act imposes duties on the importation of certain oil products, including petroleum-based oils and greases, and preparations for the treatment of textile materials, leather, furskins or other materials. The Act sets out the specific rates of duty for each of these products, which vary depending on the type of oil or preparation being imported (section 1-9). Failure to comply with the requirements of the Customs Tariff Amendment (Product Stewardship for Waste Oil) Act 2000 (Cth) may result in criminal or civil penalties. The maximum penalty for contravening a provision of the Customs Act 1901 (Cth) is generally a fine of up to 10,000 penalty units or imprisonment for up to five years, or both, for a corporation, and up to 5,000 penalty units or imprisonment for up to two years, or both, for an individual (section 227A(1) of the Customs Act 1901 (Cth)). Additionally, the Act may also give rise to civil penalties under the Customs Act 1901 (Cth) or other relevant legislation. It is important to note that the penalties for contravening the Customs Tariff Amendment (Product Stewardship for Waste Oil) Act 2000 (Cth) may vary depending on the specific circumstances of the case.
