An Act to amend the Customs Tariff Act 1982
[Assented to 25 October 1984]
BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:
Short title, &c.
1. (1) This Act may be cited as the Customs Tariff Amendment Act (No. 3) 1984.
(2) The Customs Tariff Act 19821 is in this Act referred to as the Principal Act.
Commencement
2. (1) Sections 1 and 2 shall come into operation on the day on which this Act receives the Royal Assent.
(2) Section 3 shall be deemed to have come into operation on 1 January 1983.
(3) Section 4 shall be deemed to have come into operation on 23 November 1983.
(4) Section 5 shall be deemed to have come into operation on 6 April 1984.
(5) Section 6 shall be deemed to have come into operation on 30 May 1984.
(6) Section 7 shall be deemed to have come into operation on 1 July 1984.
(7) Section 8 shall be deemed to have come into operation on 6 July 1984.
(8) Section 9 shall be deemed to have come into operation on 18 July 1984.
(9) Section 10 shall be deemed to have come into operation at the hour of 8 o’clock in the evening by standard time in the Australian Capital Territory on 21 August 1984.
Phasing rates
3. Section 13 of the Principal Act is amended by omitting from paragraph (4) (a) “the tariff classification” and substituting “a tariff classification in Schedule 3”.
Indexation of rates of duty
4. Section 26a of the Principal Act is amended—
(a) by inserting in sub-section (2) “on a particular day” after “substituted” (first occurring); and
(b) by inserting in sub-section (3) “on a particular day” after “substituted” (first occurring).

5. The Principal Act is amended as set out in Schedule 1.

“3. (1) In 84.53, “automatic data processing machines” means—
(a) digital machines that—
(i) have storages capable of storing not only the processing program or programs and the data to be processed but also a program for translating the formal programming language in which the programs are written into machine language;
(ii) have a main storage that is directly accessible for the execution of a program and has a capacity sufficient at least to store the parts of the processing and translating programs, and the data immediately necessary for the current processing run; and
(iii) are able, of themselves, on the basis of the instructions contained in the initial program, to modify, by logical decision, its execution during the processing run;
(b) analogue machines that are capable of simulating mathematical models and comprise, at least, analogue elements, control elements and programming elements; or
(c) hybrid machines that consist of—
(i) a digital machine with analogue elements; or
(ii) an analogue machine with digital elements.
(2) A reference in sub-note (1) to machines shall be read as including a reference to such machines in the form of a system consisting of a variable number of separately-housed units each of which is part of the complete system, that is to say, a unit that—

(i) the central processing unit; or
(ii) a unit capable of being connected to the central processing unit, either directly or through one or more of the other units;
