Overview

The Statutory Rules 1967 No. 9, made under the Customs Act 1901-1966, were enacted to amend the Customs Regulations in response to the transition to decimal currency in Australia, which occurred on 14 February 1966. These Regulations were introduced by the Governor-General, acting on the advice of the Federal Executive Council, and they include amendments to various provisions of the Customs Regulations to reflect the new currency system. The purpose of these amendments is to ensure that the Customs Regulations are aligned with the decimal currency system and to facilitate smoother customs operations by updating monetary references throughout the Regulations. This legislative instrument aims to maintain the accuracy and relevance of the regulatory framework governing customs procedures in Australia.

Scope and Application

These regulations, made under the Customs Act 1901-1966, apply to all individuals and entities engaged in import and export activities within Australia. They encompass a broad range of conduct and transactions associated with the importation and exportation of goods, as well as the transit of goods through Australia. The geographic reach of these regulations is national, as they apply throughout the Commonwealth of Australia. Notably, these regulations update various references to the Customs Tariff, replacing references to the Customs Tariff 1965 with the Customs Tariff 1966. Additionally, certain forms and sections previously related to specific duties or processes have been amended or omitted, reflecting changes in the legal framework and administrative practices. The amendments include updates to monetary values to reflect decimal currency, as well as the removal and replacement of certain forms to streamline customs processes. The regulations do not specify exclusions or exemptions but imply that any changes or new requirements must be adhered to by those subject to the Customs Act. Subordinate instruments may extend or further detail the application of these regulations as necessary.

Key Provisions

The primary sections of these regulations amend and update the Customs Regulations of 1901-1966 to align with the changes brought about by the Customs Tariff 1966 and the transition to decimal currency in Australia. Regulation 1a modifies the definition of "primage duty" to reflect changes in section 27 of the Customs Tariff 1966 instead of section 25 of the Customs Tariff 1965 (Section 1). Regulation 41 is updated to reference the Customs Tariff 1966 instead of the Customs Tariff 1965 (Section 2). The heading "TRANSIT PERMITS" is removed from the Customs Regulations (Section 3). Regulation 72 is amended to reference section 20 of the Customs Tariff 1966 instead of section 19 of the Customs Tariff 1965 (Section 4). Furthermore, Regulation 73 is expanded to include X-ray apparatus and related items as taxable goods (Section 5). These regulations impose various obligations on the parties involved in customs processes. They require that customs declarations and entries be made accurately and in accordance with the updated forms and currency standards. For example, the new forms (Form 14 and Form 38a) now use the dollar sign ($) instead of the old currency symbols (£ s. d.), and certain fees and values have been converted from pounds to dollars (Sections 8 and 10). Furthermore, these regulations require that certain sections of the Customs Regulations be omitted and that the new forms replace the old ones (Sections 6 and 7). Failure to comply with these regulations can lead to various civil and criminal consequences. While the regulations do not specify particular penalties, breaches of customs laws generally can result in fines, imprisonment, or both, depending on the severity of the offence. The maximum penalties for serious breaches of customs laws can include substantial fines and imprisonment for several years. Therefore, adherence to these updated regulations is crucial for ensuring compliance and avoiding potential legal repercussions.
