2. Statutory Rules 1956 No. 90 as amended to date. For previous amendments see Note 2 to Statutory Rules 1980 No. 71 and see also Statutory Rules 1980 Nos. 71, 78, 150, 211 and 368.

Overview

The Statutory Rules 1980 No. 376, made under the Customs Act 1901, were enacted to amend the Customs (Prohibited Imports) Regulations, providing specific guidelines on the importation of pre-packed goods and modifying the Third Schedule. The Regulations were introduced to address issues related to the importation of certain pre-packed goods that do not meet specified weight or measure requirements. This legislative instrument was created by the Governor-General of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, with the intent to provide clarity and regulation around the importation of goods that are packed for sale. The policy objective of these Regulations is to ensure that imported goods comply with set standards to protect consumers and maintain fair trading practices.

Scope and Application

The Customs (Prohibited Imports) Regulations, made under the Customs Act 1901, pertain to the importation of goods that are either prohibited or subject to specific conditions when packed for sale. These regulations apply to any person or entity attempting to import goods listed in the schedules of the Regulations into the Commonwealth of Australia. The regulations specify particular weights, measures, and permissible packaging for various food products, beverages, personal care items, and other consumer goods. These conditions are designed to ensure consumer protection and compliance with national standards. The regulations also outline certain exclusions and permissible weights or measures for each category of goods, ensuring that the imported goods meet Australian standards. The scope of the regulations is further extended through subordinate instruments, which can provide additional detail or modify the application of the regulations as needed.

Key Provisions

The Customs (Prohibited Imports) Regulations 1980 (the Regulations) under the Customs Act 1901 govern the importation of certain pre-packed goods into Australia. Regulation 4AA sets out the specific conditions under which the importation of these goods is allowed. According to the Regulations, the importation of pre-packed goods is prohibited unless certain weight or measure conditions are met, as specified in Schedule 6. The permissible weights or measures are listed for various goods, including butter, margarine, cooking fats, sugar, tea, and many others. These permissible weights or measures are detailed in Schedule 6, which lists the minimum and maximum allowable weights or measures for each specified item. The Regulations impose several obligations on the parties or entities involved in the importation of these goods. Importers must ensure that the goods they are importing comply with the weight or measure requirements specified in Schedule 6. For example, if importing butter, the weight must be one of the permissible values listed in the schedule. Similarly, for items such as cooking fats, sugar, and tea, the weight or measure must fall within the specified permissible range. Importers are also required to provide accurate declarations regarding the weight or measure of the goods being imported. Failure to comply with the weight or measure requirements set out in the Regulations can result in various civil or criminal consequences. While the Regulations themselves do not explicitly state the penalties for non-compliance, violations of the Customs Act 1901 can lead to fines and potential criminal charges. The penalties for breaching customs laws can include substantial fines and, in severe cases, imprisonment. The exact penalties depend on the nature and severity of the breach, as determined by the courts. Importers found to be in violation of these regulations may also face the seizure of their goods, which can result in significant financial and logistical consequences. In summary, the Customs (Prohibited Imports) Regulations 1980 impose specific weight and measure requirements on the importation of certain pre-packed goods into Australia. Importers must ensure that their goods comply with these requirements, and failure to do so can result in significant civil and criminal penalties.
