Part 1—Preliminary

Division 1—Preliminary

1  Name

  This instrument is the Customs (Approved Statements) Instrument 2025.

2  Commencement

  This instrument commences on 1 October 2025.

3  Authority

  This instrument is made under section 4A of the Customs Act 1901.

Division 2—Definitions

4  Definitions

Note: A number of expressions used in this instrument are defined in the Act, including the following:

(a) Customs place;

(b) duty;

(c) import declaration;

(d) import entry;

(e) movement application;

(f) outturn report;

(g) self-assessed clearance declaration;

(h) visual examination application;

(i) warehouse declaration.

  In this instrument:

Act means the Customs Act 1901.

Customs Regulation means the Customs Regulation 2015.

Department means the Department of Home Affairs.

International Obligations Regulation means the Customs (International Obligations) Regulation 2015.

Lloyd’s Register identification number means the International Maritime Organization number assigned to the ship importing or exporting goods.

UN/LOCODE, in relation to a place, means the code that applies to the place as published by the United Nations Economic Commission for Europe.

Part 2—Approved statements

5  Impending arrival reports

  For the purposes of section 64 of the Act:

 (a) the “Impending Arrival Report (Air) Statement” in Schedule 1 to this instrument is approved as an approved statement for communicating to the Department an electronic report of the impending arrival of an aircraft at an airport in Australia; and

 (b) the “Impending Arrival Report (Sea) Statement” in Schedule 2 to this instrument is approved as an approved statement for communicating to the Department an electronic report of the impending arrival of a ship at a port in Australia.

6  Arrival reports

  For the purposes of section 64AA of the Act:

 (a) the “Arrival Report (Air) Statement” in Schedule 3 to this instrument is approved as an approved statement for communicating to the Department an electronic report, reporting in respect of the particulars of the arrival of an aircraft at an airport in Australia and the time of arrival; and

 (b) the “Arrival Report (Sea) Statement” in Schedule 4 to this instrument is approved as an approved statement for communicating to the Department an electronic report, reporting in respect of the particulars of the arrival of a ship at a port in Australia and the time of arrival.

7  Notifying of particulars of cargo reporters

  For the purposes of section 64AAB of the Act, the “Notifying of Particulars of Cargo Reporters Statement” in Schedule 5 to this instrument is approved as an approved statement for communicating electronically to the Department a report, reporting in respect of the particulars of a second cargo reporter where the first cargo reporter has entered into an agreement or arrangement with the second cargo reporter under which cargo, for whose carriage the second cargo reporter is responsible, is to be carried on a ship or aircraft into Australia.

8  Report to Department of persons engaged to unload cargo

  For the purposes of section 64AAC of the Act, the “Persons Engaged to Unload Cargo Statement” in Schedule 6 to this instrument is approved as an approved statement for communicating electronically to the Department a report, reporting in respect of particulars of:

  (a) in the case of a ship—the stevedore with whom the operator has entered into a contract for the unloading of the cargo from the ship at a place in Australia; or

 (b) in the case of an aircraft—the depot operator who will first receive cargo after it has been unloaded from the aircraft at a place in Australia.

9  Outturn reports

 (1) For the purposes of subsections 64ABAA(1) and (4) of the Act, the “Outturn Report (Air) Statement” in Schedule 7 to this instrument is approved as an approved statement for communicating electronically to the Department:

 (a) an outturn report in respect of cargo that has been unloaded from an aircraft at an airport in Australia; or

 (b) an outturn report in respect of cargo unloaded from an aircraft that has been moved, under a permission given under section 71E of the Act, to a Customs place other than a warehouse.

 (2) For the purposes of subsection 64ABAA(2) of the Act, the “Outturn Report (Sea) Statement” in Schedule 8 to this instrument is approved as an approved statement for communicating electronically to the Department an outturn report in respect of a container that is unloaded from a ship at a port in Australia.

10  Crew reports

  For the purposes of section 64ACB of the Act, the “Data Elements Required for Electronic Reporting of Aircrew Statement” in Schedule 9 to this instrument is approved as an approved statement for communicating electronically to the Department, a report on each member of crew who will be on board an aircraft at the time of its arrival at an airport in Australia.

11  Request for Additional Information

 (1) This section applies to:

 (a) information referred to in subsection 71AAAO(2) of the Act in relation to a self-assessed clearance declaration;

 (b) information referred to in subsection 71DA(2) of the Act in relation to an import declaration;

 (c) information referred to in subsection 71DL(2) of the Act in relation to a warehouse declaration;

 (d) information referred to in subsection 110(4) of the Customs Regulation in relation to an application for a refund, rebate or remission of duty.

 (2) For the purposes of sections 71AAAO, 71DA, and 71DL of the Act, and section 110 of the Customs Regulation, the “Request for Additional Information Statement” in Schedule 10 to this instrument is approved as an approved statement for communicating electronically to the Department the information to which this section applies.

12  Underbond Movement Applications

  For the purposes of sections 71E and 71L of the Act:

 (a) the “Underbond Movement Application (Air) Statement” in Schedule 11 to this instrument is approved as an approved statement for communicating electronically to the Department a movement application to move goods imported into Australia by air that:

 (i) are subject to customs control; and

 (ii) have not been entered for home consumption or warehousing.

 (b) the “Underbond Movement Application (Sea) Statement” in Schedule 12 to this instrument is approved as an approved statement for communicating electronically to the Department a movement application to move goods imported into Australia by sea that:

 (i) are subject to customs control; and

 (ii) have not been entered for home consumption or warehousing.

13  Section 71E Movement application

  For the purposes of sections 71E and 71L of the Act, the “S71E Movement Application Statement” in Schedule 13 to this instrument is approved as an approved statement for communicating to the Department a movement application to move goods that:

 (a) are subject to customs control; and

 (b) have been entered for home consumption or warehousing.

14  Withdrawal of an import entry

  For the purposes of sections 71F and 71L of the Act, the “Withdrawal of a Declaration Statement” in Schedule 14 to this instrument is approved as an approved statement for communicating electronically to the Department a withdrawal of an import entry.

15  Visual examination application

  For the purposes of sections 71D, 71DK and 71L of the Act, the “Visual Examination Application Statement” in Schedule 15 to this instrument is approved as an approved statement for communicating electronically to the Department a visual examination application.

16  Application to deal with goods imported temporarily without duty

  For the purposes of sections 114 and 162AA of the Act, the “Export Declaration or Application under Section 162A(6A) of the Customs Act 1901 Statement” in Schedule 16 to this instrument is approved as an approved statement for communicating electronically to the Department, either:

 (a) an electronic export declaration; or

 (b) an application communicated by computer under subsection 162A(6A) of the Act to take goods aboard a ship or aircraft for export where those goods were delivered as a result of an application described in subsection 162A(2A) of that Act.

17  Refunds etc. of duty

  For the purposes of section 163 of the Act, and section 107 of the Customs Regulation and section 26 of the International Obligations Regulation, the “Refund, Rebate or Remission Application Statement” in Schedule 17 to this instrument is approved as an approved statement for communicating to the Department an application communicated by computer for a refund, rebate or remission of duty.

18  Schedules

  Each instrument that is specified in a Schedule to this instrument is amended or repealed as set out in the applicable items in the Schedule concerned, and any other item in a Schedule to this instrument has effect according to its terms.

Schedule 1—Impending Arrival Report (Air) Statement

Impending Arrival Report (Air) Statement

The date the aircraft departed from the place identified in item 4.

Last Overseas Departure Time

The time the aircraft departed from the place identified in item 4.

7

Aircraft Registration Number

The international registration code assigned by the appropriate aviation authority for the aircraft.

8

Responsible Party ID

The Australian Business Number (ABN), or code allocated by the Department (the Customs Client Identifier or CCID), that identifies the operator of the aircraft. 

9

Responsible Party Name

The name of the operator of the aircraft.

10

Codeshare Airline Code

If part of the space used to carry goods on the aircraft has been leased to another airline – the IATA code of the other airline.

11

Codeshare Flight Number

If part of the space used to carry goods on the aircraft has been leased to another airline – the flight number used by the other airline to identify the flight.

12

Overseas Routing Port

For each place outside Australia that the aircraft stopped during the flight – the UN/LOCODE for the place.

13

Arrival Port Code

The UN/LOCODE for the place in Australia where the airport/s, to which the report relates, is located (the airport/s).

14

Estimated Arrival Date

The date that the aircraft is expected to arrive at the airport/s.

15

Estimated Arrival Time

The time that the aircraft is expected to arrive at the airport/s.

16

Cargo Discharge Indicator

Indicate whether goods will be unloaded at the airport/s to which the report relates:

(a) If cargo is to be unloaded: YES;

(b) If cargo is not to be unloaded: NO.

 

Schedule 2—Impending Arrival Report (Sea) Statement

Impending Arrival Report (Sea) Statement

First Arrival Port Code

The UN/LOCODE for the place where the first Australian port the ship is expected to arrive at is located.

Principal Agent ID

The Australian Business Number (ABN), or code allocated by the Department (the Customs Client Identifier or CCID), of the principal agent of the ship.

10

Overseas Routing Port Code

For each place outside Australia that the ship stopped during the journey – the UN/LOCODE for the place.

Slot Charterer ID

The ABN or CCID of the slot charterer (if any) who has leased cargo space from the principal agent for the ship.

Arrival Port Code

The UN/LOCODE for the place in Australia where the port/s, to which the report relates, is located (the port/s).

13

Estimated Arrival Date

The date that the ship is expected to arrive at the port/s.

14

Estimated Arrival Time

The time that the ship is expected to arrive at the port/s.

15

Cargo Discharge Indicator

Indicate whether goods will be unloaded at the port/s:

(a) If the cargo is to be unloaded: YES;

(b) If the cargo is not to be unloaded: NO.

16

Stevedore ID

The ABN or CCID assigned to the stevedore who is unloading the goods on board the ship at the port/s.

Stevedore Establishment ID

The identifier of the stevedore establishment that is unloading the goods on board the ship at the port/s.

If the report relates to a voyage of a ship – the unique number assigned by the principal agent of the ship for the particular journey to Australia.

Associated Cargo Reporter Identifier

The Australian Business Number (ABN), or code allocated by the Department (the Customs Client Identifier or CCID), of the cargo reporter with whom the communicator has entered an agreement or arrangement under which the cargo reporter is responsible for cargo carried on the ship or aircraft during the voyage or flight.

Freight Forwarder Indicator

If goods are being imported into Australia and are a coload/consolidation – indicate if another cargo reporter will be providing further cargo reports.

 

Schedule 6—Persons Engaged to Unload Cargo Statement

Discharge CTO Identifier

If the cargo was imported by air – the identifier of the cargo terminal operator (CTO) who will first receive the goods after it has been unloaded from the aircraft when it arrives at the airport.

Scheduled Arrival Date

The date the aircraft, that was carrying the cargo, arrived at the first airport in Australia where the cargo was unloaded.

Outturn Establishment ID

If the report is being communicated under:

(a) subsection 64ABAA(1) of the Customs Act 1901  the unique identifier assigned to the depot that received the cargo and to which the report relates (the depot);

(b) subsection 64ABAA(4) of the Customs Act 1901  the unique identifier assigned to the Customs place that received the cargo and to which the report relates (the Customs place).

Outturn Date

If the report is being communicated under:

(a) subsection 64ABAA(1) of the Customs Act 1901 – the date the cargo was unloaded from the aircraft;

(b) subsection 64ABAA(4) of the Customs Act 1901 – the date the cargo was received at the Customs place.

7

Outturn Time

If the report is being communicated under:

(a) subsection 64ABAA(1) of the Customs Act 1901 – the time the cargo was completely unloaded from the aircraft.

(b) subsection 64ABAA(4) of the Customs Act 1901 – the time the cargo was received at the Customs place.

8

Responsible Party ID

The Australian Business Number (ABN), or code allocated by the Department (the Customs Client Identifier or CCID), that identifies the depot operator or operator of the Customs place responsible for making the report.

9

Master Air Waybill Number

For each line of cargo  the master air waybill number for the cargo.

10

House Air Waybill Number

For each line of cargo  the house air waybill number for the cargo.

11

Number of Packages

For each line of cargo  the total number of packages of cargo.

12

Damage Indicator

Indicate if the unpacked cargo is damaged:

(a) If the cargo has been damaged: YES;

(b) If the cargo has not been damaged: NO

13

Outturn Result Type

Indicate if there are any discrepancies between the cargo report relating to the cargo and the goods unloaded:

(a) There are no goods included in the cargo report that have not been unloaded and there are no goods not included in the cargo report that have been unloaded: NIL

(b) Surplus Consignment – There is a consignment that has been unloaded that is not included in the cargo report: SC.

(c) Shortage – There are goods included in the cargo report that have not been unloaded: SH.

(d) Surplus Packages – There are packages that have been unloaded that are not included in the cargo report: SU.

Pillage Indicator

Indicate if any cargo is suspected of being stolen:

(a) If any cargo is suspected of having been stolen: YES.

(b) If cargo is intact: NO.

Goods Description

A detailed and accurate description of the cargo.

 

Schedule 8—Outturn Report (Sea) Statement

Outturn Report (Sea) Statement

The identifier assigned by the person communicating the report to identify (and distinguish from others) the report and all subsequent amendments to the report.

Sender Reference Version

The numeric identifier assigned by the person communicating the report to identify the version of the report or sequence of related reports.

Vessel ID

The identifier of the ship which carried the cargo:

(a) the Lloyd’s Register identification number of the ship; or

(b) if the vessel does not have a Lloyd’s Register identification number – the identification code allocated to the operator of the ship by the Department.

4

Voyage Number

The unique number assigned by the principal agent of the ship that carried the cargo.

5

First Container Discharge Date

If the report is the first outturn report – the date that the first container was unloaded from the ship.

6

Container Number

The unique identifier assigned to the container which is being unloaded.

7

Container Responsible Party ID

The Australian Business Number (ABN), or code allocated by the Department (the Customs Client Identifier or CCID), that identifies the party responsible for the container.

If the cargo is containerised and is being unloaded from a ship, items 8 to 12 are also required (See subsection 64ABAA (2) of the Customs Act 1901)

Stevedore Establishment ID

The identifier of the stevedore establishment that is unloading the goods on board the ship at the port.

9

First Container Discharge Time

If the report is the first outturn report – the time that the first container was unloaded from the ship.

10

Last Container Discharge Date

If the report is the last report – the date that the last container was unloaded from the ship.

11

Last Container Discharge Time

If the report is the last report – the time that the last container was unloaded from the ship.

12

Restow Indicator

Indicate if a container will be unloaded and replaced on the ship.

If the cargo is bulk or break bulk and has been unloaded from a ship, items 13 to 17 are also required (See subsection 64ABAA(3) of the Customs Act 1901)

Cargo Type

The cargo type allows cargo on a vessel to be classified into broad categories as these categories have differing reporting requirements. There are five cargo types:

(a) FCL (Full Container Load) – containers where all the contents are consigned to one entity.  There is only one consignment in the container;

(b) FCX – sea cargo containers where a container has all the contents consigned to one entity in Australia and where there are two or more consignments within the container;

(c) LCL (Less than Container Load) – a consignment that does not occupy the full space available in a container. The consignment has been consolidated, i.e. packed into a single container, with one or multiple other LCL consignments. These consignments must have at least two different consignees in Australia;

(d) B/B (Break Bulk) – a consignment of cargo that is transported in a noncontainerised manner. Most break bulk consignments are comprised of self-contained units/packages (for example, cars or timber packs); and

(e) BLK (Bulk) – consignments of goods that conform to the shape of the vessel holds that the cargo is being transported in and does not have any external packaging, for example, gas, grain or petroleum.

House Bill Number

A House Bill of Lading (or House Bill) is issued by an entity (usually a freight forwarder) to identify individual consignments and each House Bill has a unique identifying number.

15

Ocean Bill of Lading Number

An Ocean Bill of Lading is issued by a shipping company for the carriage of goods on a vessel and each House Bill has a unique identifying number.

Responsible Party ID

The Responsible Party ID identifies the party who is responsible for unloading, unpacking or receiving the cargo. The identifier can be either the party’s ABN or CCID.

Outturn Result Type
