1 Name of Determination [see Note 1]

  This Determination is the Currency (Royal Australian Mint) Determination 2007 (No. 6).

2 Commencement [see Note 1]

  This Determination commences on the day after it is registered.

3 Specifications of coin

  For subsection 13A (1) of the Currency Act 1965, each item in Schedule 1 specifies:

 (a) the denomination of a coin; and

 (b) the coin’s standard composition; and

 (c) the coin’s standard weight, and the allowable variation from that weight; and

 (d) the coin’s dimensions; and

 (e) the coin’s design.

4 Application of Determination

  The specifications in Schedule 1 do not affect any other determination of the specifications of a coin.

While the Determination itself does not explicitly state penalties for non-compliance, breaches of the Currency Act 1965, under which this Determination is made, can lead to criminal and civil penalties. For example, under section 13A of the Currency Act, any person who knowingly manufactures or imports a coin that does not comply with a determination may be liable to a penalty of up to 5,000 penalty units for a corporation and 1,000 penalty units for an individual. Additionally, under section 13D, any person who knowingly possesses, uses, or traffics in a non-compliant coin may be liable for penalties of up to 10,000 penalty units for a corporation and 2,000 penalty units for an individual. These penalties are subject to adjustments in line with the current penalty unit values as stipulated in the Commonwealth Penalties Act 1996.
