Overview

Statutory Rules 1938 No. 80, made under the Defence Act 1903-1934, addresses the need to streamline administrative processes within the Council of Defence Regulations. Enacted by the Administrator of the Government of the Commonwealth of Australia, acting on the advice of the Federal Executive Council, this legislative instrument aims to enhance the efficiency of the Defence Department's operations by amending the Council of Defence Regulations. Specifically, the regulation updates the administrative protocol by replacing the term "the Secretary, Defence Committee" with "an officer of the Secretariat of the Department of Defence" in Regulation 8 sub-regulation (3). This change reflects a policy objective to modernise and simplify the bureaucratic structure, ensuring that Defence operations can adapt more readily to changing circumstances.

Scope and Application

The Statutory Rules 1938 No. 80, made under the Defence Act 1903-1934, amends the Council of Defence Regulations by modifying the role within the Defence Committee. This regulation applies to the Commonwealth of Australia and is designed to update the administrative framework within the Department of Defence. The amendment changes the responsibility from the Secretary of the Defence Committee to an officer of the Secretariat of the Department of Defence, thereby altering the procedural aspects of how defence matters are managed. The scope of this regulation is limited to the internal administrative changes within the Defence Committee and does not extend to altering the substantive defence policies or operational procedures. As such, this regulation serves to streamline the bureaucratic processes without impacting the broader defence strategies or public-facing activities of the Department of Defence.

Key Provisions

The main operative sections of these regulations involve amendments to the Council of Defence Regulations under the Defence Act 1903-1934. Specifically, Regulation 8 of the Council of Defence Regulations is amended ((1)). The amendment involves changing the authority responsible for certain actions or decisions from "the Secretary, Defence Committee" to "an officer of the Secretariat of the Department of Defence" ((2)). This shift in responsibility is intended to streamline or adjust the administrative processes within the Defence framework. These regulations impose specific obligations and requirements on the parties or entities they govern. By amending Regulation 8, the new requirement is that an officer of the Secretariat of the Department of Defence must now perform duties previously assigned to the Secretary, Defence Committee. This change likely aims to refine the chain of command or responsibility within the Defence administrative structure, ensuring that tasks are allocated to appropriately designated personnel within the department. The regulations do not explicitly state any new offences, penalties, or consequences for breach. However, the importance of adhering to these amendments cannot be understated, as any failure to comply with the revised regulatory framework could potentially lead to administrative inefficiencies or legal complications. While specific penalties are not detailed in the text, breaches of Defence regulations generally carry significant ramifications due to the sensitive nature of Defence operations and responsibilities. In summary, the legislative instrument primarily modifies the administrative responsibilities under the Council of Defence Regulations, assigning specific duties to officers within the Department of Defence's Secretariat. These changes impose clear obligations on the relevant parties to ensure that administrative processes within Defence are carried out effectively and in accordance with the updated regulations.
